The typical prenup is intended to deal with a situation in which one or both parties has substantial property before the marriage, and wants to make sure that property does not accidentally become marital property. For example, if I own a house when I get married, but then pay for the mortgage with joint assets, it may be tough later to figure out how much of the sales price of the house was separate versus joint. A prenup could say, for example, that I would receive X dollars plus Y% a year interest as my separate property on any divorce, reflecting the value of the house. That sort of prenup does not require the court to get involved in the day-to-day workings of the marriage, which can change over time.
@krisalicious ..: True. And if the judge is being asked to enforce a contract that says, "You get X dollars only if you have sex with me three times a week," the judge may be questioning whether that was a marriage, or a contract for prostitution.

I havent read all the posts, but I can tell you that this is inappropriate for wedding vows said in public (um, like parents, grandparents, semi stranger who came as guests.....)
I've encouraged my couples to say all kinds of things in their vows, but I wouldn't let them include this. By doing so it implies that I had some part in it, and that will never happen.
I am telling you ladies. Regulating how many times a week you have to get sex might be a great idea... H is hiding in the bedroom playing Madden and let me tell you, I can't win against that game since it just got out and we have to leave soon to pick up the newest addition to our family. A little tuxedo kitten

If this is truly not a joke, you have more problems than the obvious that need to be worked out. Nevermind the obvious (that it's extremely inappropriate, tacky, TMI, etc), but forcing someone with a low sex drive to commit to sex X amount of times per week...that's never going to work. You need to put yourself in your FI's shoes...by making this a huge deal (and believe me, when you tell him that you want to incorporate sex into the vows, it WILL be a huge deal), you are making the situation worse.

Yes, this does sound like a joke, but if you are serious, do not consider it at all, in any form. While your libido may be higher right now than his, circumstances and drive change throughout your life together. I recommend talking that out in couple's therapy if it truly is an issue in your relationship.
