I am getting married on Saturday and my fiancé 's wife will not sign the divorce papers to be spiteful. One couple in my wedding party said they do not want to be part of the ceremony because it is a "fraud." I asked a lawyer and he said there is nothing illegal about having the ceremony and legalizing it later. My "friend" said I need to tell the guests it is not legal before the ceremony or she and her husband will not be part of it. I spent a lot of money on this wedding and don't think I need to cancel it when I am doing nothing illegal. How do I explain why they are not in it? We live in a small town and questions will be asked. Could my lawyer be wrong? HELP!

No. The state could see this as fraud. If monetary gifts are exchanged, they were invited to a wedding via an invitation, and it LOOKS like a wedding.

Tabatha, you haven't done the research to support what you're saying here. As someone who could lose her whole practice over something like this, I have.

Omg so sorry you have to experience this. But in the state of Florida(maybe other states as well) he can sue her for a divorce may take a little time but it will get done. Thats what I had to do and he just got tired of the process and signed the papers. Free lady over here lol. Honestly I would call it a commitment ceremony if you cant reschulde everything sure you will miss out on some of the money you have already paid in but atleast you know your ceremony will truly mean something to you and FI as well as your guest.

I just seen what tidedaknot said about as an ex wife lol. You are sooooo right my ex had his gf thinking it was me and she approached me about it. I died laughing in he face and said baby it aint me look up the court info. Needless to say she was pissed and left him because he kept telling her the reason they couldnt get married is because I wasnt trying to get a divorce I was trying to hold on bol yeah right.

Tiedaknot.....LMAO.....I am not the crazy one. That would be his current wife. She is freaking certifiable. Me....I am most definetly the "biatchy ex wife". Sometimes being a bitchy ex wife is the only thing an ex has left when her ex hubbie refuses to see his sick child. lolol No, I am not saying the ex is right for holding up the divorce.

Okay...this is what I am not getting. Where the hell did this dude find his attorney? Walmart?

Sharon here again...I did write a statement for the Dj to read and my friend with the problem is ok with it. My big question is regarding fraud if we accept gifts for the wedding. Her issue seems to be how she will look as a party to what she calls "fraud."

Celia Milton- With all due respect I asked someone who does weddings a pastor.. so yeah. I did. And I've seen it done. Once in a circumstance much like this. Words are words unless there is a license or a document for the state. Much like a rehursal they say it but they leave stuff out or it's just words then because it's not done.

But she's doing it ANYWAY so why talk about it anymore??

On page 2 she told us all she was doing and having the DJ announce something before the wedding. So at least she's telling them.

I would like everyone to know I like apple sauce and sister wives and at this point.. this is just silly willy.

    *giggles*

Is the DJ reading this statement BEFORE the "ceremony"?

What wording is the "officiant" using so that this isn't worded as a Wedding ceremony?

Have you read any of the comments or links that have been posted about how this IS FRAUD if things are not done/said properly?

The current wife can indeed bring it up in court. http://www.divorcenet.com/states/florida/fl_art05

    http://law.justia.com/codes/florida/2012/titlexlvi/chapter798/section798.01/

Whether the ball rolls one way or the other at that point will depend on how the judge sees it.
