What is a Notary Public?
A Notary Public is a Public Official appointed to notarize documents anywhere in the State of Florida.
A Notary acts as an impartial witness to certain transactions. The notary’s participation in these transactions creates a degree of certainty and integrity that is crucial to the proper operation of business, government and commerce.
Is a marriage ceremony performed by a Notary Public of the State of Florida “legal and binding”? Is a Florida Notary Public authorized to perform a marriage ceremony outside the state, or may a Notary from another state perform a marriage ceremony in Florida?
YES. Florida is one of only three states (the other two are South Carolina and Maine) who authorize their notaries public to “solemnize the rites of matrimony.” §117.045, Florida Statutes. The Florida notary may perform a marriage ceremony providing the couple first obtain a marriage license from an authorized Florida official and may only perform such ceremony within the geographical boundaries of Florida. Thus, a Florida notary could not perform a marriage ceremony in another state. Additionally, a notary from another state, including South Carolina and Maine, could not perform a marriage ceremony in Florida. And, a Florida notary may not marry a couple who has obtained a marriage license from another state.
There are many factors which determine the validity of a marriage. Assuming, though, that the notary public is duly appointed and commissioned at the time of the ceremony, that both the bride and the groom are qualified to be joined in marriage, that the couple have obtained the required marriage license, and that the marriage ceremony is performed in Florida, the marriage would be “legal and binding.” Florida law will presume a marriage to be legal until otherwise shown. An attorney may be able to provide more specific information if required.
What officials are authorized in Florida to perform a marriage ceremony?
Section 741.07, Florida Statutes, provides that the following persons are authorized to solemnize matrimony:
♥ State judicial officers (judges) ♥ Retired state judicial officers ♥ Federal judges serving in a court with jurisdiction over a part of this state (per
Attorney General informal opinion, May 14, 1996) ♥ Clerks of the Circuit Court. Note: section 28.06 authorizes Clerks to appoint
deputy clerks who have all the same powers of the Clerk. ♥ Regularly ordained ministers of the Gospel, elders, or other ordained
clergy, if in good standing with his or her affiliate church or denomination
♥ Notaries Public ♥ Designated members of the Society of Friends (Quakers)
Is a notary public permitted to perform a marriage ceremony for two persons of the same sex? NO. Florida law prohibits same-sex marriages.
What is the fee structure?
My fee is based upon how simple or how detailed you would like your ceremony to be. I have a variety of ceremony packages depending on your needs. For couples who desire a very simple ceremony (no special package) the fee is thirty ($30.00) dollars . Please note: My fee(s) do not include your marriage license or any permits or entrance /ticket fees, or parking fees, or insurance that specific venues might require!
Nor do my fees include administrative costs and/or transportation expenses to the rehearsal/wedding venue. Mileage will be calculated based upon the United States Government, Internal Revenue Service 2009 mileage rate of 55 cents per mile for business travel.
For couples who desire more customization package, the fee will be based upon your package selection. Fees are refundable up to 90 days prior to the wedding (unless other arrangements have been made) of which $100.00 is non-refundable. Each package includes a non-denominational ceremony.
What is included in your ceremony packages?
Each package includes a non-denominational ceremony. Use sample ceremony or customize and write your own vows.
Basic Package ♥ Planning meeting with Officiate ♥ Coordinating day of ceremony and rehearsal only; ♥ Commemorative Marriage Certificate suitable for framing ♥ Certification of Your Marriage License ♥ Preparation of Sample Ceremonies/Vows for Couple to review or use
your own Vows ♥ Customization of Ceremony/Vows ♥ Draft and Final copy of Ceremony/Vows for couple’s review/approval ♥ Preparation of Officiate Agreement ♥ Preparation of Photo Waiver and Release ♥ Coordinating day of ceremony and rehearsal only ♥ Unity Candle Ceremony within Service (or other Specialty Service) ♥ Ceremonial Copy of your Wedding Ceremony ♥ Legalization and mail/personal delivery of your Florida Marriage License after the
Ceremony if applicable (a Marriage License is not required for Vow Renewals or
Commitment Ceremonies- Personal delivery of Marriage Licenses obtained in
Pasco or Pinellas Counties ONLY)
How long does the ceremony take?
Dependant upon the package you select, the number in your wedding party, etc. I tell couples to budget thirty minutes.
The entrance, the ceremony, signing, recessional etc.
Can we talk with you before we reserve?
Absolutely. Feel free to contact me with any questions you may have.
Do you have an emergency back up Officiant on my wedding day?
Yes. There is a emergency phone number that will be indicated in your “Officiate Agreement” to access an Officiate in the event of an emergency.
That "back-up" Officiate will have a copy of your ceremony as well as logistics to ensure everything goes as planned.
It is my goal to make sure your day is one to create memories to last a lifetime.
Do we have to memorize our vows? No. Your wedding day is a happy time, but also one where you can be nervous, excited, frightened all at once. To add the stress of memorizing your vows would be too much. However, if you really want to, I will do whatever you desire and be prepared in the event you change your mind(s).
You can write your own vows but come wedding day, I will ’feed them to you one word at a time’ or you may recite them yourselves.
Can we write our own vows and have friends read etc?
You sure can! I have other ceremony resources available for your selection.
Can our children take part in the ceremony? I encourage it. Often marriage is thought of as the joining of two people. In reality, marriage joins many lives which is most apparent when the Bride and/or Groom have children. The lives of your children change with yours on your wedding day and your marriage becomes the proclaiming of a new family. Without a loving commitment to those children, a wedding ceremony is incomplete. Depending on their age, personality and ability level, there are several ways in which your child can eb an active part in your wedding ceremony. Ask me for a list of ideas in how to do just that!
Can photos be taken?
Up to you. I encourage everyone to be involved. Is a rehearsal necessary and how much does it cost?
A difficult call. Tradition, moms, and bridal books say have one. Talk it over with your Officiate. You should always walk through the
ceremony with your wedding party. You may or may not need your Officiate present. (Much depends on place and size of wedding). There’s no additional cost.
What do your Officiates wear to the ceremony?
Appropriate business attire, business attire with Clergy Collar. Black robe if requested.
Does the Officiate stay for dinner etc?
I would like to but usually have another wedding ceremony or wedding rehearsal to go to. You are welcome to ask when the time comes.
What time does the Officiate arrive on our big day?
I arrive 60 minutes or so before the ceremony unless otherwise requested. In every case you should provide me an on site phone number.
Is a gratuity expected? NO. But you may feel you would like to express your gratitude for an excellent ceremony in this way.
Some couples send a thank you card with a picture. The best of all is to refer a friend. Some couples do all of the above.
Do we get to meet the Officiate? Yes. Most of my ceremony packages call for a planning meeting 30 to 90 days before the ceremony (if possible).
Other arrangements can be made as well.
How do we book you to conduct our wedding ceremony?
Call me at 727.255.9174. I will send you a sample ceremony and other resources, as well as a quote, based upon what you’ve discussed with me.
I will pencil your date in till we talk it over. You reserve by sending a fully refundable retainer (up to 90 days prior to your ceremony, or as pre-arranged)
for roughly half the fee of your ceremony package.
How long before the wedding should we book a wedding Officiate?
Every one is different. Some months are busier than others. I suggest you should book just as soon as you have your reception venue reserved.
Please call me and check my availability any time.
Where and when do I get my license?
You can apply for a marriage license at any time with stipulations. Every marriage license shall be issued by a County Court Judge or Clerk of the Circuit Court
under his or her hand and seal. The County Court Judge or Clerk of the Circuit Court shall issue such license, upon application for the license, if there appears to be no impediment to the marriage. The couple to be married must provide positive proof of identity and age when they apply for their marriage license. No blood test is required.
How much does it cost to obtain a Florida Marriage License?
The fee for a marriage license is ninety-three dollars and fifty cents ($93.50)
With successful completion of a Premarital Preparation course (four-hour course), the license fee is discounted thirty-two dollars and fifty cents ($32.50),
for a total cost of sixty-one ($61.00) dollars, and is effective immediately with no waiting period. The wedding may take place that day.
How long must I wait from the time I get the license until I can marry? Is it three days? Yes. The state of Florida requires a waiting period in order to prevent rash or spontaneous marriages that are not carefully and thoughtfully considered.
This is to ensure both parties consent to the contract and fully understand the gravity of the agreement they are preparing to enter.
Florida’s waiting period is three days.
Florida couples may choose either the mandatory, three-day waiting period, or a four-hour Premarital Preparation Course
(with course certificate of completion) as provided for in Section 741.0305, Florida Statutes.
The course must be taught by an instructor registered with the Clerk of the Circuit Court, and valid instructor registration
will be confirmed by the Clerk’s Office at the time the couple applies for the marriage license.
With successful completion of a Premarital Preparation course (four-hour course), the license will be effective
immediately with no waiting period. The wedding may take place that day.
Marriage License Requirements
1. Both parties must be over 18 years of age, (if under 18, ask for additional information)
2. If both parties are Florida residents there is a 3-day waiting period, unless the couple has taken a 4 hour premarital class and has documented proof.
- If both parties are out-of-state residents, the 3-day waiting period is waived.

8. LICENSES ARE VALID FOR 60 DAYS…make sure the ceremony will be held within this time period.
9. Cost of the license is $93.50, payable in CASH ONLY
