Vent! FH's divorce was never finalized!!!

My FH was previously married and left his ex in June of 2015 and filed for divorce later that month. By November of 2015 they had gone to court and received temporary orders for everything (split of property, custody of their child, etc). His ex and her attorney were responsible for drawing up the final divorce decree. Two years later and less than 5 months from our wedding and we just found out his divorce was never finalized...and his ex knew the whole time and kept it that way. FH is in the wrong for not checking in with his attorney but he received a draft of the divorce decree and assumed it was done...all that was missing was his exs signature and then she had to go before the judge with FHs attorney once she signed.

ETA: the issue is that the ex, or I guess current wife, has made it clear she plans to make it difficult. She has even taken to social media sayin. "Ps we are still married so good luck with the wedding" with a big smiley emoji

    I'm so sorry, how stressful for you both!! The laws are different in every state. Just google how long do you have to be divorced before getting remarried. I think in Texas it is 60 days, not sure about where you are. If the divorce decree isn't finalized before the wedding, just have your ceremony and reception and go to the courthouse to make it "official" once the legal aspects are in order. If his attorney is any good he will be able to get it done in plenty of time!

    I am so sorry!I was absolutely dogged about getting my divorce finalized and it was an awful hassle, I hope everything goes smoothly for your FH.

    Sorry your going through this. I went through a divorce in 2015 and thankfully I had gotten my papers saying it was finalized. Took 3 months. Hope yours doesnt take that long.

    We are getting married here in Texas but their divorce is in Oklahoma. Oklahoma law says you can't remarry within 6 months and if you do we can't cohabitate in OK. TX says 60 days. We don't plan on cohabitation in OK but I am not sure if we follow the 60 days in TX or how it works. I'm also freaking out about if it will even be final 60 days before our wedding. We found out yesterday morning and all I want to do is cry.

    Sounds like FH's attorney dropped the ball if he was supposed to go before the judge with the ex and never notified FH that it didn't happen. Hope it all gets resolved quickly

    Definitely blame FH's attorney! The attorney is paid to make sure things are finalized!! So sorry to hear this!
