I asked my former employer for the transfer. He refuse to do it. He told me that I had to find a store on my own. I asked my former employer for the transfer. He refuse to do it. He told me that I had to find a store on my own. Unemplyment rejected my claim because they said that I terminated myself because i did not commute to MA where the job was. My husband lives in another state so why is it that i would have to commute 6 hours to go and back. I have a 10 year with ADHD.They informed me that I voluntarily quit my job. How can unemployment side with my employer when they did not help me obtain a transfer to my home state. I can't afford a lawyer, my husband had financial issues before our marriage. He is finally caught up with is past bills. I am afraid that hiring a lawyer would cause us to fight financially. I feel suck!!!

    Yeah, you can't quit or leave a job to move with a significant other and receive UE.

    Contact a temp agency for something for right now. Good luck!

    Eight years is a decent amount of time, but sometimes we think that job longevity should earn us something more than what it does -- which is a paycheck.

    I know you've heard it, so I won't say it again. I'm just chiming in to let you know that an appeal would be an emotional and practical waste of time and energy. Your state's eligibility requirements are very clear, as is the appeals process. Any lawyer worth his degree would tell you that on the phone. You simply don't qualify -- separation from your job has to be through no fault of your own, and in this case, the word "decision" is a good substitute for the word "fault". State laws vary, but in Mass., no deductions were taken from your paycheck to subsidize your employer's mandatory contributions. In the future, be careful how you deal with former employers. References are like bridges -- you don't want to burn them. Good luck. You can do this. There are several pharmacies in your area. Try Walgreens.

    I quit my job to travel and move with H when his career took off, before we were married. I never thought about collecting unemployment - even if I could have, I guess I figured it was my choice to quit, move, and take my chances. We just calculated all those costs of me not working into our decision before I pulled the trigger.

    Besides all of that, I guess I don't see why it would be CVS's responsibility to create a job for you in your new area if they're not hiring at all? I'm no legal expert that's just how I see it.

    Regardless - I would say, if you're pursuing this, I would delete this and all social media posts about it. You'd be amazed what comes up in a google search, if someone is trying to defend themselves or discredit someone.

    @Amber - I have noticed when it comes to laws protecting workers CA tends to be the exception rather than the norm. Most states aren't quite as generous.

    Both my parents are pharmacists in PA and I can tell you that there are not a ton of positions available. My mom has been on a waitlist to transfer to a store closer to her home for months so far and nothing. She travels over an hour and a half to work. It isnt easy. And CVS didnt fire you, so no, you shouldnt recieved unemployment. You quit and moved and they didnt have a job for you where you are moving. You can't expect them to fire someone in PA so you can have a job. But jobs open and depending on what you do at CVS, there are many more pharmacy jobs available- go to another chain or look at hospitals if you are a tech/pharmacist. This was your choice and I doubt they will side with you on this one. I would forget the lawyer because you will lose that money. Focus your time and energy on finding a new job.

    Yes your right but ca taxes are getting out of control too because of it, I guess that's why I said we pay into it lol

    You chose to leave the place that hired you, so you did terminate. You had a job, your priority was getting married and moving, you could have found a job where you were moving before leaving your job. That's how they can reject your claim.

    Many places do their own hiring, I know most franchises do, so transfering to another of the same company isn't an option. Did you go to that branch and apply and get a note recommening you from your boss?

    I know I can't just transfer to another hospital to work, I'd have to apply and go through the board, if there was even a position at the time. Otherwise my husband and Iwoudl have chose to move to his hometown where we'd have family and free childcare. I can't just quit and apply for unemployment cause they didn't transfer me.

    Thank GOD Elizabeth! I've moved 4hrs away and been without a job, you save your money and then move and look for a job. I've been without work for the longest 3 months and never has it ever occured to me to get on welfare. You take any damn job you can get, or at least I did, worked at a booth in the mall, worked at Wendy's, then kept looking for a better higher paying job. You are able go work even if that means working at dunkin' donuts and only making enough to pay for a day care at the time being.

    IMHO, you could have secured a transfer all on your own. Companies offer transefers as a "courtesy" and it is NOT a legal obligation on their part. Your life choice to marry and relocate is by no means an entitlement to unemployment. You did choose to leave employment on your own, they did not terminate you or lay you off. It sucks that you are unemployed and I wish you nothing but the best while you search for a job. Appeal if you wish to do so but it takes just as much time and energy to do that as it would to just find a new job. Good luck and I'm sure you will find something soon =)

    This thread has gotten a little rawr but anyways, at this point I would really advise not contacting your former employer on facebook and try smoothing over that situation so you can get the good reference you deserve! It's going to be difficult to get a job when the last place you worked out for 8 yrs wont give you a great reference.

    I once was a sandwhich artist and had to drive an hour each way to work right beside Disney world. It SUCKED. PO tired tourist and their grumpy kids...no thanks! I had to do it though because I really needed the job. Dont be afrait to expand that search outside of CVS. Goodluck!

    Guys seriously stop fighting. I just wanted to put my situation out there so others will learned from it. Yes it is a learning experience for me. Ray, Ray he left me no choice but to contact him on facebook. He would not give me his e-mail. I did not post it on his message board. I did private messages with him, I have more class than that. The point is I made an effort to secure my job. I have lost nothing what they did lose was a good employee.

    I am on unemployment right now because I got laid off from my previous job. I do find it personally unfair for someone who quit from a perfectly fine job and expect to get unemployment, when I am on a time limit right now to find a job because my benefits end soon. Even when you are on unemployment, you are required to look for work, keep records of it, even have copies of your applications that you have filled out. My opinion, look for a job. Money is money. And you could have tried to get in touch with him other than Facebook. You could have called, left messages, tried to set up an interview with him when he is not busy to talk to him about this situation. Facebook is just not the place to do it. That's just my opinion though.

    For anyone who has answered based on some other state's law, or based on "right to work," neither of those is relevant. Eligibility for unemployment is based entirely on a state's unemployment insurance law, which is separate from its right to work law.

    It sounds like your previous job was in Massachusetts? In that case, the following rule applies:

    3. Will I be eligible for UI benefits if I quit my job?

    According to the law, if you left your job voluntarily with good cause (attributable to your employer) or for an urgent or compelling personal reason, you may be eligible. However, you must meet all the requirements of the law, including being able to work if a job were offered to you. If you are disqualified for any reason, you have the right to file an appeal.

    I'd suggest filing an appeal on the ground that you left work for a compelling personal reason, and see where that gets you.

    Majority of the time unemployment will not pay for voluntary quits. Even tho you were refused a transfer you still quit to move. it sucks I was in your shoes when i had to quit to move too. but I understand cause employers cant pay everyone that quits there job. you have to look at it from a fair business perspective.

    It looks as though this post has gotten a little bit on the negative side, and I would like to apologize if I had any part in that. I was never intentionally trying to give a viewpoint one way or another on this topic, i was just trying to state facts that I know about this subject to help the person who posted. I understand and hear what all of you ladies are saying, and Im sorry that some of you have negative feelings toward the things that I posted.

    Darlene, you can/and should try to appeal the matter, but it is highly unlikely that you will prevail. Your employer does not have to transfer your employment because you are moving to another state. However, before leaving your previous place of employment, you should have spoken with the store manager and advised that you would like to transfer and would be submitting application to stores in the area you are moving. The fact that you were taking the initiative would have benefited youur situation.

    Also, you don't have to submit a letter of resignation to advise your employer you will no longer be in their employ. You can just not show up and abandon your job. On paper, that's what your situation looks like.

    And by the way, Facebook is not the place to discuss this matter.
