Unemployment benefits rejected my claim because i got married and move with my husband to his homestate

I asked my former employer for the transfer. He refuse to do it. He told me that I had to find a store on my own. Unemplyment rejected my claim because they said that I terminated myself because i did not commute to MA where the job was. My husband lives in another state so why is it that i would have to commute 6 hours to go and back. I have a 10 year with ADHD.They informed me that I voluntarily quit my job. How can unemployment side with my employer when they did not help me obtain a transfer to my home state. I can't afford a lawyer, my husband had financial issues before our marriage. He is finally caught up with is past bills. I am afraid that hiring a lawyer would cause us to fight financially. I feel suck!!!

    They (employer) do not have to grant a transfer, it is up to their discreation. If you quit your job because of this, you are not eligible for unemployment benefits. In fact if you quit a job period, you are ineligible. You must be laid off/fired by the employer in order to be considered for unemployment. The only thing you can do is get a new job.

    The Unemplyment Office did not deny you because you got married and moved, they denied it because you quit your job.

    @Kasey C. that is not entirely true. I have a friend who got unemployment after he quit because the job had a high turnover rate, so it was considered unsatisfactory working conditions and that was for Lowes! I myself quit my job to move and because my job was a local one, I was eligible for unemployement. It really depends on your state.

    ^ agree with Kasey. I was able to transfer at a past job to a new location and the way they handled it was as though I was a re hire.

    I think it depends on state to state but where I am from if you volunteer to quit your job they will reject you to recieve immediate unemployment benifits, after a period you can reapply.

    I know why the big difference. I bet you all live in a right to work state? Correct if I'm wrong. I didn't live in a right to work state. That is a big difference.

    There are situations that they will consider on a case by case basis, such as if the employer didn't did follow certain rules and regulations, but again it is a case by case situation. OP situation isn't a unsatisfactory working conditions. She quit her job to move and in their eyes why should the employer pay her unemployment benefits where there is gainful employment in her new location and by law the employer did nothing wrong? They view it as her choice.

    I live in a right to work state.

    Right to work states stink IMO.

    I'm sorry for the job issues but it's probably in your best interest to just look for a new job. That's what I would do anyways!

    That does suck. Can you find other work in your area? Chalk it up to a learning experience and next time wait until you have a job lined up to move.

    @ Kasey C. that is why I was able to quit my job and was eligible for unemployment to follow my FH. I do not live in a right to work state.

    Thanks for the advice guys! It live in PA it would be crazy for them to be asked to travel 6 hours to work one way to MA and 6 hours back home. My husband works out of state so I can not just leave my daughter with any stranger. I worked for CVS Pharmacy the 10 pm. to 7 am shift. I thought since they have stores on every corner. I would have no problem getting a transfer. What bothers me the most is that my former boss did not even try to help with the transfer. I did not want to leave my job I wanted a tranfer and got the run around from this company. My daughter gets on the bus at 7:09am. There is no way that would be a good parent if I can see her cause of the traveling distance. This whole law 151 A Section 25 is not fair. How can a husband and wife be living in two different states. I am praying to God and looking for work, things are still hard has far as the economy goes!!!!!

    Have you applied at a CVS where you live now? It might be very easy to get a job there since you've already been working there.

    I'm confused... I'm not sure that the driving 6 hours one way would ever be an option for anyone.

    This is just life, far as I know. You get married, you move, one of you has to change jobs and life goes on. I don't even know how unemployment benefits made it's way into this... How have you done it for the past 5 months?

    I would appeal it, I know LOTS of people who get unemployement for that very same reason. As long as you have a legitamate reason for quitting your job, and you cannot commute to and from work (6 hours insist a realistic commute) you should be able to collect...

    I spoke to a cvs rep she told me to go online to their website. I put in my title and zip code. There is no opening or hours in my state. I went to serveral stores before filing the claims. I was told in each store I went to that they did not have any hours. They say that I quit but I never got a pink slip. When i confront my boss on facebook that i never gave gim a letter of resignation. His come back was that I never gave him a particular store number for the transfer. He started avioding me altogether. I don't think I will ever work or do any kind of business with this company. I worked for them for 8 years. I was not a fly by employee.

    Why not apply to CVS or another drug store where you live? Having the experience I imagine will put you ahead of many who apply. They can't exactly pay out unemployment for everyone person who quits and moves.

    If I was your previous boss I wouldn't discuss employment/unemployment on facebook either, so I don't blame him for "avoiding" you.

    And you can't just look at CVS, there are jobs at other places too...

    You didn't get a pink slip because you quit.

    You should never, ever contact a boss on facebook. It shows unprofessional judgement on both of your parts.

    Sorry Darlene but all you can do now is learn from your mistake and move on. I would suggest contacting a temp service, if the job search doesnt improve. Good Luck!

    Yea I am not really sure why you should get unemployment? You chose to move from the job your employer hired you for. Yea it sucks they didn't help you move, but that shouldn't mean you are entitled to be paid by the government. If you move out of state and don't show up for work, that means you quit.

    This should have been a discussion with your husband before you decided that you should move to him. If you couldn't find a job, you shouldn't have moved if you couldn't afford it. Plenty of people have had to have long distance relationships, even in marriage. It's a want and not a need.
