Cake Baker cancelled on me! Only 75% deposit back???

The cake baker we had originally picked called us about a month ago in a panic. She stated," I fired my decorator and will not be able to do your grooms cake because of the fondant (it was going to be a model of FH's set of dumbells, weights, and his Gold's Gym gloves- loves to work out!)." She also said," I could do your wedding cake though, if not I can get your deposit back to you within the week because we may not even be in BUSINESS-wtf? by your wedding"

I replied," Okay, well let me talk to FH and will get back to you."

We discussed it and decided the shop was being strange and we could not afford that kind of liability... her canceling right before the wedding. Eek!

We called, and we called, and we tried calling her more. ( Shops name is "Cakes & Moore- how ironic?!) She would not answer, and turned off the shop's voice mail recording. I finally got ahold of her a week later to tell her, "Thank you but we are going to have to go with another shop since you don't know if you will

    You need 100% of your deposit back, immediately. Sounds like you may be taking her to court if she doesn't comply. I'd start a very throrough record of every attempt to contact her, details of what was discussed during phone calls (recordings would be GREAT, but are hard to do), and copies of emails, etc.

    You are sorry she went out of business, but you paid for a service you didn't recieve.

    I'm sure you're typing more but I think that if they cancelled on you, you should be entitled to a full refund of all moneys paid.

    Even be open- I was kind of pissed by this point so I may have been rude. She said rudely," Okay you will only get 75% of your $100 deposit back since you are cancelling....." I said okay and hung up- I was sooo mad!

    Uh... what is wrong with that statement? Didn't she JUST say not a week ago that SHE was canceling on ME?

    Now it has been 2 weeks since that phone conversation.... and no check.

    What do ya'll think? Should she give me the full deposit because she basically canceled on me?

    If SHE cancelled, she owes you 100% of your money back.

    Oh wow...she's going to declare bankruptcy! Get that check before she does, or you'll never see it! GO DOWN THERE!

    Remind her, your contract is for TWO cakes, one of which she can no longer provide. She is cancelling the contract, because she can no longer fulfill the order. You expect a full refund, immediately. When can you pick up the check?

    OH! Then she said during that 2nd convo," Oh I can do your grooms cake, just not your wedding cake because of the detail...." Total contradiction to her last statement about what she could and could not do

    If you paid the deposit by credit card, I would call your CC company to see if they can do anything.

    Put everything in writing, dates of phone calls, what was said, etc. If you leave a paper trail, it is much harder for her to dodge out.

    Oh, and the total amount I was going to be paying... drum roll please... $691!

    I went with a different local shop- $423! And they are so much nicer, and WILL NOT be going out of business considering they have been open since the 40'sSmiley smile

    What does your contract say regarding her end of the deal? If it is set for two cakes, then she is the one in breach of the contract, regardless of the fact that you chose to no longer acquire her services.

    Errrr it kind of sounds like even though she stated she didn't think she'd be able to do the cakes she wanted you to cancel on your end so that it came across that you were cancelling the contract and not her. Total bs. She cancelled I would be demanding the full amount back and if not she'd see her little bankrupt ass in court.

    Can you visit in person? I would go in with a copy of your contract and point out to her that she is not fulfilling it by not creating one of your cakes. If not in person then send her a letter via certified mail.

    She is never in her shop, for good reason apparently! She has a rating of "F" on the BBB website. She isn't a member, how convenient?

    That sucks! I'd just keep bugging her by phone and put a letter in the mail just so you have something documented showing you have tried to obtain your money back from her. I don't know if 100 dollars is worth the hassle of court, but that's kind of up to you.

    Do you have something in writing from her stating that she would be unable to fulfill the contract? If not, it is your word against hers. Which really means nothing in court. If you are truly going with another company, and you can't get her to cancel in writing thus voiding the contract, you need to cancel the contract or you will be liable for the remaining balance. (Remember you signed a contract saying you would make payments, if you don't you are in breach of contract). In the end you will lose more than the $100 deposit. Send a certified return receipt letter to use as proof, just in case.

    If she canceled you definitly deserve 100% of that deposit back.

    How can she honestly expect you to take the chance with her when she said herself she may not even be in buisness by then.

    Such bull! Go down there and demand your money back!!!!
