Cake Baker cancelled on me! Only 75% deposit back???

The cake baker we had originally picked called us about a month ago in a panic. She stated," I fired my decorator and will not be able to do your grooms cake because of the fondant (it was going to be a model of FH's set of dumbells, weights, and his Gold's Gym gloves- loves to work out!)." The cake baker we had originally picked called us about a month ago in a panic. She stated," I fired my decorator and will not be able to do your grooms cake because of the fondant (it was going to be a model of FH's set of dumbells, weights, and his Gold's Gym gloves- loves to work out!)." She also said," I could do your wedding cake though, if not I can get your deposit back to you within the week because we may not even be in BUSINESS-wtf? by your wedding"

I replied," Okay, well let me talk to FH and will get back to you."

We discussed it and decided the shop was being strange and we could not afford that kind of liability... her canceling right before the wedding. Eek!

We called, and we called, and we tried calling her more. ( Shops name is "Cakes & Moore- how ironic?!) She would not answer, and turned off the shop's voice mail recording. I finally got ahold of her a week later to tell her, "Thank you but we are going to have to go with another shop since you don't know if you will

    She owes you ur full deposite back...she did not provide you with a service and even said she can't provide the service she contracted for, so she owes you the full amount in my eyes!

    Yuck! This totally sucks. If you have a contract for 2 cakes, and she will only supply 1, she is in breech of contract. Do you have an attorney? If so, sometimes, a letter from a lawyer solves these nuisance issues.

    Just let it go. Sounds like this baker is just totally going out of business. I know you have a contract, but you can't get blood from a stone.

    This person has much bigger problems than just you, and you don't need the stress.

    You found a new baker, go get married and be happy.

    My venue cancelled with me!!!!! That upset me but thats a whole nother debate.. I had to get another venue! I hear ya and I hope it works out for you!

    Since it's only $25, I would just call her once and if she doesn't agree to give you the full amount, threatened to sue her. The threat alone might make her just hand over the $25 as the court fees wouldn't be worth it. If not, report her to the BBB, leave bad reviews all over the web, and cut your losses. I know it's the principle, but I don't know if it's worth the extra stress.

    She said she may not be in business by then, therefore you do not have a reasonable expectation that she will even deliver one cake; and as Meghan noted the contract is for two cakes, she is in material breach. 100% of your money back immediately or you will contact a lawyer. Although be aware that even if you go to court, pay the court costs and win a judgment against her, you can not get blood from a stone, no matter how legal the judgment is.

    She can not legally keep any of the deposit if she canceled your order. Demand the rest of your money she can not legally refuse. If you have to you can call the police to have them help you retrieve the rest of your money. The owner will be brought up on extortion charges of she refuses.
