Wedding Venue in Breach of Contract? Need Advice!!

michelle, on March 16, 2016 at 1:32 PM Posted in Planning 0 14

A few weeks ago I got notification that there would be a new person handling our wedding. My FH and I met with her and loved her. She informed us that they would be remodeling this summer but the remodeling would be complete before our wedding.. NBD However she did say that where we were signed to have our ceremony was out of the question with a wedding our size and that we would have to get married with housing backdrop vs Fountain/Lake Backdrop. she mentioned that they may be constructing a new spot but would not know for sure till 3/11. I followed up with her on 3/12 with no response then yesterday she emailed and said

"I do apologize for it taking so long to respond. As it turns out, as of right now, there will be no space available for outside use of any kind, for a wedding your size. There are plans to make adjustments and additions to the patio area, I am just not sure when that would take place.

We can certainly still accommodate your reception in our ballroom."

If you signed a contracted that you agreed to pay a certain amount for a certain ceremony location, then they are breaching the contract and you should be able to renegotiate. You should check the fine print to see if they are allowed to do that and what your rights are.

In no event shall ****** be liable for consequential damages of any nature for any reason. If the space reserved hereunder is not available for the event, ******* may substitute other space, similar or comparable. In any event, ******* shall not be liable beyond the amount paid for the use of rooms reserved or other advance payments made to the Association. "

Here is what the contract says that may be my saving grace. Our wedding is for 125 ppl and we were signed for ceremony on the patio and Reception in the ballroom.

If they don't have a ceremony site but still offer the reception can I let them know to term the contract? How do i go about getting my Deposit back?

Could you just move your ceremony to another location and keep the reception space? I would not try to terminate the contract until you know that you'll have another space reserved. You're 7 months out from your wedding finding an entire venue will be difficult. I would just try moving the ceremony.

I haven't looked into it, but i'm afraid it will only add more expenses to have it at separate locations and I already exceeded my budget for Photography.

There is a clause in my contract that says my venue can move the room I am in if they have to.

They won't, because there are no other rooms, but still. Is there something like this in your contract?

It says that they can subsitute for something similar but based on her response i don't think there is any solution to the ceremony site issue since she ended with "We can certainly still accommodate your reception in our ballroom."

How many people are coming that they are unable to hold an outdoor ceremony?

It looks like the contract says they can substitute a location for one that is comparable. Are they saying they can't hold your ceremony at all? In that case, it seems as though you just wouldn't pay the ceremony fee, and your deposit would just go to the cost of the reception. Unless you now don't want to have the reception there, then it sounds like you can point to that section of the contract and request the deposit back?

    Date twin!

I'd be on the hunt to find another venue before burning a bridge here. Can you have the ceremony in the ballroom worst case?

Ask them what their solution is for your ceremony. If it's not what you had signed for (barring fine print) they should refund you any costs for your ceremony so that you can use that money towards a new location.

This is a pretty big thing to change and while it does happen, they should make concessions/accommodations to keep you happy.

According to the terms you posted, it sounds like they're offering you the indoor reception area as an alternative "substitution". If you are dead set on having an outdoor ceremony, I'd speak to them about alternatives, even getting your money back at this point. The the indoor ceremony is suitable, I'd still see if you could negotiate down since this was not what you agreed to.
