What If Marriage Licenses Expired & Needed To Be Renewed To Continue The Marriage?

The Bride, on July 20, 2019 at 11:42 AM Posted in Community Conversations 0 14

What if marriage licenses expired and needed to be renewed to continue the marriage?

Some people might argue that a marriage license should expire like every other state license to give people the option to part ways or renew.

Other people might argue that the purpose of marriage is to be life-long so it would not make sense for the license to need to be renewed.

What are your thoughts? Should marriage licenses expire and need to be renewed to continue the marriage? Why or why not?

From what I understood, a marriage license is strictly a permit to get married, once you're married that's it. You then receive a marriage certificate to show you are married, but that is not the same as the license

You are correct but my question is a hypothetical one.

I can't find a benifit to the expiring ones myself. I've heard the idea tossed around and I just don't get it. Why bother to get married if it's not permanent?

That’s a really interesting question. I know a lot of people who probably wouldn’t renew theirs, which is kinda sad to think about. I guess it’s cheaper than divorce.

That's a good question. I guess it would lessen the divorce rate since technically your just not renewing, right? I don't know, its an interesting topic though.

Would not renewing be different from divorce?

I think it would change the way we define divorce.
It'd also change how we go about things like alimony, determining child support too.

Why would we want it to expire, Drivers License do so they can recheck eye sight make sure you look like your photo. Make sure height weight if you were glasses is updated. So if you don’t renew it you marriage is over? tThis would that help with child support kids are still there. If marriage expired kids do not expire with it We would still need divorces so couples know who gets what. A marriage license expiring will only add stress.

I think the danger in this is that “not renewing” would have to fall under similar laws to divorce, especially in cases where spousal support, child support, or allocation of assets would be necessary. In states where common law marriage exists, those parties still go through a “divorce” in order to separate so this would be the same thing.
