Wedding Venue Asking for Photos from Photographer

Hi all,

We think we found the venue for our wedding, but as we're reviewing the contract, we found a clause stating -

"This venue uses still photography to assist with promotion of the venue. The venue requests use of all photos taken at venue by your photographer for promotional purposes."

I found a photographer that I really like and she hasn't come across this before.

No contracts with the venue or photographer have been signed, but I'm caught off guard. Has anyone had experience with this before?

    I think my contract says something like the first part. Just whatever pictures the venue takes they can use for marketing. But they aren't requesting pictures from my photographer. That does seem odd.

    That's very odd… I've heard of venues sharing photographer's pictures taken at said venue for promotional purposes, but never a request for the entire gallery. That wouldn't sit right with me. Some of those photos are very personal

    Typically venue contracts, as pp mentioned, say that any photos they take, they can use for promo purposes. I’ve never heard of venue demanding photographer photos. That doesn’t sound fair. I would tell the venue to take that out of the contract or rewrite as mentioned above. I changed so many things in our venue contract that were unfair or didn’t make any sense, so don’t be shy to ask.

    27. Usage Rights: Client hereby grants TRADEMARK the absolute right and permission to take and use a photograph(s) and or video(s) of Client in its promotional materials. Client releases TRADEMARK, the photographer, their offices, employees, agents, and designees from liability for any violation of any personal or proprietary right Client may have in connections with such use.

    this is what my venue had in the contract. My fiancé and I have not signed anything as we need to revise this into something more approving to us.

    It doesn't seem fair for them to receive high resolution quality pictures and video from our photographer as we will be the ones paying for them and our photographer spending his time in working on them and making them perfect. Seems fit for me that if the venue wants to use them for promotional purposes they should hire their own photographer and pay them to do so with approval of the bride and groom.


    No ONE likes to work for free and photographers are not always given the credit and pay they rightfully deserve for all their hard work. How can I ask them to change it or simply take it out without coming off as rude or offensive?
