Thinking on taking our wedding photographer to small claims court

Hi all! Just wondering if anyone has experienced taking their wedding photographer to small claims court and what the outcome was?

I am seriously considering taking my “photographer”. We had our wedding 8/11/18, fast forward almost a year later and I am still waiting on him to give me all the work that was in the contract.

First, let me begin by saying that I have been extremely patient as he lost his son back in June. It was after I had already made the non-refundable deposit, which was also before we had scheduled our engagement shoot and, unfortunately, before we were told by family about his bad rep of not giving them his clients their photography in a timely manner.

We we ended up having our engagement shoot 2 weeks before our wedding. No big deal, as he was dealing with a loss. Out of all the pictures, only about 10 were edited.

Fast forward to the wedding day, he does not show up. Instead, he sent another photographer and did not even tell me. The videographer happened to be someone I knew through one of my friends which told me he never had plans to work my wedding when I had asked where he was. In the contract it does say that if he is unable to make it then he would send a team to cover the event however he never had plans to attend and that is what makes me livid.

In the contract it states (and he also told me in person which is what sold me) that he would give us all of our stuff within 30 days. Turns out, it took him 60+ days to give us JUST THE PICTURES. He printed 100 off and our contract stated he would print is 150. No acrylic albums and no video. And to my luck, be broke things off with the videographer (they ended on a bad note due to his lack of professionalism) so he asked me to do him the favor as they were not in speaking terms & reach out to him since I knew him to get the video. He did end up giving me the video in September, however there were a few things that I asked him to change and he believed he gave us the wrong copy, so he said he would give us the correct copy, however it is now August and the videographer is completely ignoring me now.

I am sorry this is so long, but I’m just looking for advice as it is now about to be our 1 year anniversary and I am out of 2 acrylic albums and the main part - a quality video. I know I made the contract with the photographer so I feel like he needs to get the video just like the rest of my work. It’s just so frustrating we spent so much money and I have been nothing but patient and understanding and I am getting screwed over.

any advice would be greatly appreciated :/

    Take his butt to court and get your money back! I hope you're able to be compensated!
