Rights to Wedding Video/photography?

Chanieish, on October 28, 2019 at 2:39 PM Posted in Planning 0 6
Hi!

We are in contract-signing stage for our wedding videography. On the contract it states that the videographer owns all rights to the video and has irrevocable and unrestricted rights to publish videos where the client and his/her guests may appear.

I'm guessing this is normal? But I don't want my face plastered everywhere. I have a professional internet profile where my patients look me up and stuff and I don't want them to see anything related to my wedding.

The videographer is very flexible and says that he can take that out, but sharing photos would be limited also.

Is it possible for me to own the rights to the video? I am paying for the service after all and its my face haha! How should I approach this and what should i ask?

Thank you all!

In my experience, this is very typical. It's their work, so they should own it. However, I would ask to have a clause included that they need your permission to attach your name to anything, or something like that.

I agree with Lady, this is pretty standard. As PP said, it's their work and you're just paying them for a service. If they weren't allowed to use their own work from past jobs, they'd never be able to build a portfolio or advertise. You could just ask them not to "tag" you in the posts that include you on Facebook, Instagram, etc. That way if someone searches your name, it wouldn't pop up at all.

Thank you ladies for the clarifications!

The company seems very easy to work with and are willing not to post any videos of myself and my guests online, so I am very thankful for that. If all goes well I am more than willing to give them excellent reviews anywhere they need.

It is normal. They’re not goi Nd to waive rights to their product, but youre certainly well within your rights to make requests as to where your face ends up— not tagging you, not using names, etc. We have some vendors that use their photos of our events a lot on their social media, but only ever use first names so there’s no actual searchable link from me to them. Our caterers made a promotional video for their website from our wedding — we gave permission for their filming but specifically asked that we NOT be in it, and that they stay away from our ceremony. Everyone was happy to oblige. If you knew where to look, you could find stuff from my wedding. But you definitely can’t do it by googling my name! So, the “art” will always belong to the “artist” but you have rights and can make requests as to how they use it (they could of course say no, but, then you could find someone else who would! So they’re unlikely to be unwilling to negotiate as it’s not beneficial to them)

I saw the same in a lot of photography contracts when I was booking! We ended up choosing our photographer because she was willing to add to the contract that our written permission would be required for the sharing of ANY image from our wedding. I really appreciated this, and honestly would be willing to pay an upcharge for the privacy.

Keep looking for someone who honors your wishes!

    Thanks for the replies!

After explaining my side to the videographer/photobooth company, they removed that clause from the contract completely and will not post any imaging or videos online! They really accommodated me and my FI and I am very excited to work with them! Smiley smile
