Put down deposit now I'm ghosted

Kelly, on December 16, 2017 at 6:19 PM Posted in Wedding Attire 0 28

So my situation is; I signed with a wedding venue, they had great reviews, just opened a new space, contract seemed standard, so I signed and put down the $$$$ deposit. A month later; the partner left, a wedding couldn't get into the venue (on the day of the wedding!), and the guy went MIA. A couple weeks after I am in panic, i text the owner "should i be concerned" (my wedding is nov 3rd next year). He finally responds " no! Come on by." So i bring my folks, we ask about an addendum (hey we all make mistakes big or small). Basically incase he continues these bad practices or goes bankrupt, a sign of good faith, he says "of course". That was Nov 3rd this year, I have contacted him repeatedly since then, no response, no addendum. I heard through friends that a caterer just refused to work with them a week ago. They couldn't get into the venue for a rehearsal dinner. The contract says the deposit is non refundable. I dont think it will work out with them. Is there anything I can do?

If you lose the deposit it might be worth it especially if things are going as bad as they are.

I would check into wedding insurance. They cover your deposits and such should a vendor go out of business. There are a few companies for insurance. Call and ask about your situation and see if it will be covered

    It doesn't specifically cover

that. But in the liability clause it states that unless it is a natural disaster I don't get.my money, what you paid is nonrefundable. However a 30 day notice means I won't have to pay the full amount. I just think these are circumstances you don't usually encounter. The addendum would have have given me coverage but that never happened

Yikes! I would keep trying to contact them. If no response, id file in small claims. Hopefully that's all you'll have to do, it may scare him and give you your money back and then you can file a dismissal. If not, I say you have a good case. Proof of failed contact and maybe a statement from a vendor might help.

I can get and have records. Is a small claim something I would need a lawyer for?

No you don't, just file the paperwork. You can usually get them online under your county website.

You don't need a lawyer. Can you call your credit card or bank and see if you can dispute the charge to get a charge back?

Kelly, are you asking me? If so, I would speak to your branch manager or credit card dispute department and explain the situation, bring proof that he did not let the wedding party into the venue the day of the wedding, proof about the caterer and explained you and the vendor came to a mutual decision that there would be an addendum in the contract and it has been x days and the contract has not been rectified, and you aren't able to get ahold if him and want to charge back the charge. The bank will open an investigation on there end, he may or may not give the refund back on his own terms once he receives notice from the bank.

You call your creditor and tell them you wish to dispute that charge. The creditor has by 90 days to complete investigation. If they find reason they'll credit your account. Has it been within 60 days though? If it has its still worth a try.

Cancel if you can, pursue it through your CC company, and FGS, all of you should be getting wedding insurance. We had three venues and two dress salons go out of biz in August/Sept alone.

Meantime, I'd find another venue. I really hope you get your money back. I hate when things like this happen. So much unnecessary stress put on you.
