Put down deposit now I'm ghosted

So my situation is; I signed with a wedding venue, they had great reviews, just opened a new space, contract seemed standard, so I signed and put down the $$$$ deposit. A month later; the partner left, a wedding couldn't get into the venue (on the day of the wedding!), and the guy went MIA. A couple...

So my situation is; I signed with a wedding venue, they had great reviews, just opened a new space, contract seemed standard, so I signed and put down the $$$$ deposit. A month later; the partner left, a wedding couldn't get into the venue (on the day of the wedding!), and the guy went MIA. A couple weeks after I am in panic, i text the owner "should i be concerned" (my wedding is nov 3rd next year). He finally responds " no! Come on by." So i bring my folks, we ask about an addendum (hey we all make mistakes big or small). Basically incase he continues these bad practices or goes bankrupt, a sign of good faith, he says "of course". That was Nov 3rd this year, I have contacted him repeatedly since then, no response, no addendum. I heard through friends that a caterer just refused to work with them a week ago. They couldn't get into the venue for a rehearsal dinner. The contract says the deposit is non refundable. I dont think it will work out with them. Is there anything I can do?

    Talk to your bank about options to dispute the charge for services not as agreed / not as described type of scenario. It's not a definite option but they might guide you

    Also note .. I investigate these things with a bank. Your circumstance is unique. The bank can attempt to help you but the company can just respond with a contract that the deposit is non refundable. It's that easier for them unfortunately.

    There should be a clause in the contract that if they fail to fulfill their obligations, you are due a full refund. It's pretty standard in venue contracts I've seen.

    You are not an idiot. He is a bad businessman. If your bank won’t help you you have a VERY good shot in small claims. Also, look at hiring a lawyer to send him a letter stating that if the situation is not rectified with a full refund for services not rendered as agreed upon that you will be pursuing legal means of doing so. That could be all the push the guy needs.

    Honestly...I'd lose the deposit in that situation. Guy sounds like a mess.

    File a consumer complaint with your states attorney general. Usually if you do that, you'll have to wait to take them to court. However sometimes they can get them to pay you back so you wouldn't have to go to court.
