Photographer not fulfilling contract

It has been 13 months since my wedding and my photographer has delivered the electronic version of the photos, but has not yet delivered the photo albums as agreed upon in the contract. I've paid everything in full, and he has not responded to any emails, text or phone calls.

Can anyone provide advice on what to do? Is small claims court the next logical step to pursue?

    Do you know if they're still in operation? I'd maybe suggest trying to physically track them down or send an email stating it's your last point of contact before going toward legal matters so see if that wakes them up. Or you could have a friend email them inquiring about photo packages.

    The only thing I'd wonder is if they're actually still around. I remember a bride or bride to be finding out that their photographer died or something before too. You never know!

    You Betcha. Don't let them screw you. 13 months is outrageous!!!! I've been married almost 6 months and I already have my album. I bet you if you threatened them saying your going to send them to small claims court you would magically have your photo album? But as SXC said you may wanna see if their still in business.     Definitely check if their still in business, although, I would think if they were out of business, they would have contacted all their pending orders/clients to let them know they were going out of business and that they either wouldn't be fulfilling their end of the contract (which I would totally expect a refund, in part, for) or that it would take them longer to deliver your services. I'd do what SXC suggested and try to contact first to see if they're still around, and then moving forward with legal action. I think there was a bride or groom on here not too long ago that said they were getting super frustrated with the lack of communication from their photographer and came to find out that he died! Definitely pursue the issue though if your contract hasn't been fulfilled.

    I would send a "Demand Letter", registered/return receipt, giving him ten business days to get your photos books to you. Let him know that if you do not receive them within ten days, you will contact the Small Claims Court.

    Read your contract -- is he past his deadline?

    Is he waiting for you to pick the photos for the album?
