Getting out of a photographer contract

Patricia, on August 13, 2015 at 10:54 AM Posted in Etiquette and Advice 0 13

I started planning my wedding unsure of my budget so I jumped the gun and signed a contract with a photography company. I have yet to put my deposit down. I realized after that I shouldn't have done it. I started looking at other photographers and fell in love with another ones work. Now I'm not sure what to tell his guy. I feel horrible but I don't think I will get the quality I want from him or his company. I'm not sure if he will force me to pay the deposit or not either.

Was a contract signed? With only a verbal agreement I think you're in the clear, maybe a vendor can shed some light on this... But I would feel like you're fine.

What does the contract that you signed say? I don't know how a contract can be valid if you haven't sent in the deposit.... or if you could be held to pay the deposit.

I think its in my car still but I believe it said the only way to break contract is with the consent of both parties and i would forfeit any deposit. But all I did was sign it. I never paid anything so I wonder if I am still able to get out of it and I'm not sure how I'm going to tell him. I cant say I found someone better.

You need to talk to him, I don't think we're going to be able to help you! You can just tell him you may have jumped the gun and have decided to go another direction.

If you never gave him the signed contract(did you give the contract to him?) or gave him a deposit just call or send him an email and tell him that your situation has changed and you unfortunately will not be using his services.

I signed it at his office and I kept a copy. I guess I have no choice but to tell him what's going on and see if he is understanding

Well of course you have to talk to him. It'd be super rude to just drop off the face of the earth. He needs to know you're going in a different direction so that he can open your date back up for other brides. You should do this asap.

I fully intended on talking to him, I just wasn't sure how I should approach it without offending him or breaking my contract and having to pay the deposit.

That's tough. I hate having to "break up" with vendors. You could just say that you discussed with your fiancé and have decided to go another direction. Or maybe something about evaluating your budget and his services don't fit within that, or something!

How long ago did you sign the contract? Since you are still a year out from your wedding date the photographer might be accommodating and release you from the deposit obligation, but if they do force you to pay the deposit there is not much you can do because of the signed contract.

Yeah you might have to pay the deposit anyway.
