Fiance got fired for calling out during snow storm..

My fiancé got fired a couple weeks ago due to snow. We live in an apartment building and the snow removal people didn't come until 6pm so my fiancé had to call out of work which he wasn't originally scheduled for. He was covering someone else's shift. Apparently during his absence something happened...

My fiancé got fired a couple weeks ago due to snow. We live in an apartment building and the snow removal people didn't come until 6pm so my fiancé had to call out of work which he wasn't originally scheduled for. He was covering someone else's shift. Apparently during his absence something happened and he was fired for calling out. He had his hearing with unemployment today and the employers statement was that my fiancé quit for personal reasons. He is blown away that they would lie like this. I am so worried he wont get unemployment now. He doesn't have proof with text messages that he was fired because they spoke on the phone.

    I have had to fight for unemployment before. I was a teacher, laid off due to budget cuts, and the first day of summer I received a letter offering to make me a sub on the sub list. Because of this letter, I was considered "employed." It took about 7 months and 3 rounds of appeals but I finally got my claim approved.

    Your FH will just have to keep explaining what happened. He may have to go in person, frequently. That's what I did because here in NJ in 2010 there were way too many people trying to call in. I could never get through on the phone. I went in person and I waited in line, about once a week. He'll feel like he is repeating himself a million times. It will be worth it. All he needs is the one right person to make the judgement call that he was in fact fired because he couldn't report to work in the snow.

    Thanks! he actually is in the process of applying for the fire department and we probably wouldn't have noticed they were hiring unless he got fired so I am sure there is a reason for everything. We just need something to get him through the next few months. And hopefully we can move past this stronger than before.

    That sounds so messed up! he needs to have a talk with his boss. Go straight to the company and ask to speak to the person over his bosses head, have him ask why he was fired and to give him a written note stating why he was fired. I think its actually illegal to fire someone for calling into work (regardless of snow) now if he just didn't show up at work that would be grounds for firing. I work at a hospital and I am expected to be there for work (no matter what weather conditions) and if I call in because of snow I would get a write up, but not fired. You should call a lawyer.

    also, he got fired over the phone? don't employers have to fire you in person?

    Sorry you're going through this. You said he was covering someones' shift, is this a full time job? How long has he been at the company?
