Fiance got fired for calling out during snow storm..

My fiancé got fired a couple weeks ago due to snow. We live in an apartment building and the snow removal people didn't come until 6pm so my fiancé had to call out of work which he wasn't originally scheduled for. He was covering someone else's shift. Apparently during his absence something happened and he was fired for calling out. He had his hearing with unemployment today and the employers statement was that my fiancé quit for personal reasons. He is blown away that they would lie like this. I am so worried he wont get unemployment now. He doesn't have proof with text messages that he was fired because they spoke on the phone.

    Wow.

    Does he have any other sort of proof? Messages to anyone else on that day that he was calling off due to weather?

    Sadly this seems like the common thing lately where employers turn out to be shady as hell. I hope it all works out for your FH.

    Usually employers require a written letter of resignation, to prove an employee has left of their own volition. They have no such letter, as you have no termination papers, so at this point it's hearsay.

    Did his employer call him to fire him? If so you can show through phone records that they had called him to inform him

    My fiancés supervisor called him to call the head supervisor so I guess you could say that my fiancé called but when the guy said "hey mike is really ma, it doesn't look good, you have to call him." Hopefully if I print the phone records it could help. I just hope they don't believe that.

    I don't think anyone left any massages for him and they would probably be deleted by now.

    What BS! He should just be like "oh you didn't fire me? I'll just keep working then!" If there's no proof that he left maybe he doesn't have to leave :-P

    Most employers aren't going to spend the time/money/effort to fight if an employee says the termination circumstances were different, so I'm keeping my fingers crossed that your FH won't have any problems qualifying for the unemployment. But of course, you can most likely cross off that employer as any sort of a reference for future jobs he applies to.

    Wow, this kind of thing pisses me off. These employers really do sound shady. As Zelda said, if they don't have a letter of resignation from your FH, then they'll have a hard time proving he quit. I really hope this works out for him!

    I would fight this hard. An employer can not hold it against you if you call out due to weather reasons. Your safety is more important than the job. This sounds super shady and I would suggest that he gets a lawyer since this is not common practice.

    That's a battle fighting for at least for the unemployment.no exit interview, no two weeks? Yeah. Nope. I wouldn't want my job back working for those assholes, but unemployment. Yes. Worth the fight.

    I very much doubt they had cause to terminate him unless it had a string of documented disciplinary action. I would definitely fight if I were him. I work in HR but live in Canada so laws may be different there.

    What state are you guys in? That will make a huge difference. Did either of you speak to anyone else-not just from his company, that day and tell them he had to call out because of weather? Can you get your landlord or anyone else to write a letter or something saying you guys couldn't leave your building? those things will put more weight in your favor, plus the phone logs showing he was called first BEFORE he called his head supervisor.

    Also Threaten the company with a lawsuit for wrongful termination (because SERIOUSLY), back pay, and I'm wondering if you can get something for slander or libel because they're are lying and it couldn't be detrimental to your fiance's reputation if it gets out he "quit" without notice. (not saying actually sue, but usually threats work miracles with rats like these)

    Luckily my landlord is my boss and she is an attorney so she can help. I didn't tell her he is unemployed because I don't want her to think I cant pay rent. It isn't fair considering hes never been written up or anything and a job isn't worth anyone's life.

    File an appeal with unemployment. I'd look into getting legal help for it. Your boss is going to need the full set of info to really help you, but if you aren't comfortable with that (or if she hasn't offered to handle this), you can also look into local law schools with labor clinics and Legal Aid's labor services. This situation seems well-suited for a clinic.

    There's a chance you might also have a wrongful termination suit (not nearly enough facts here to know, but might be worth looking into). If you're going to sue for wrongful termination, a lot of employment lawyers will work on a contingency basis w/o requiring any $ up front.

    I know someone in Ohio who was fired and filed discrimination reports against the company, there was no evidence of discrimination, but the company wanted to save face and paid him a huge settlement. I would fight this hard.

    Well I guess he'd better find something quick in case they don't give it to him. Luckily my work closed and I was scheduled off so we got paid when we got snowed in because the snow plow people didn't come to out place for days. I'd still file an appeal and get a note from your apartments stating when the snow plow people came or something. But the best bet if yall need money if for him to go get a quick job instead of waiting around

Thanks Richard I don't think we will bring any lawyers into it unless they continue with lying but I think it is a very smart idea for him to go along with it and say exactly what you said "so this was all a misunderstanding? I can come back to work?"

    I don't have any real advice as to how to get him the unemployment. But my husband got laid off during the wedding planning, and he has a much better job now maybe this all work out for the best.
