Claire, on October 5, 2018 at 10:08 PM Posted in Wedding Ceremony 0 9
Hey everyone,
my fiancé is in the military in VA but we are both from PA. I’m am not yet a resident in VA (trying to hold out until we get married and he doesn’t need to change his residency) can we get our marriage license in VA and get married here and then have our church ceremony in PA?

You don't have to be a resident of the state where you are getting married. Just make sure that if you are getting married in VA that you know the laws of where exactly to get your marriage license. Some states are anywhere in the state, some are in the county where you are actually getting married I'm how a separate church wedding works though. You should call your priest/pastor and he should be able to answer that question.

You have to gave a marriage license in the state you are getting married. It does not have to be your state of residency. Different states have different requirements for licenses. Make sure you know them

I think you should check your state laws.

You can get your marriage license in Virginia, get married in Virginia, then have a ceremony in Pennsylvania. But why would you want to? You might as well get your marriage license in Pennsylvania, and then have the ceremony in Pennsylvania be your actual marriage.

We are currently both residing in VA. He doesn’t have to but I don’t want to change my residency so I would need to do it soon so I can keep my residency in PA.

It doesn’t matter where you reside. If you’re a citizen, you can get married in any state you want. You get your marriage license in the state you’re getting married in.

Where you get married has nothing to do with your residency. We got married in Massachusetts, for example, even though neither of us was a resident there. You just have to get your marriage license in the same place you get married.

Are you trying to hold out to get married to change your residency to help with a last name switch? I live in VA and you have 90 days to change your drivers license before it’s an issue, so be careful with that. Va cops are pretty strict about that.

I agree with PP who says why would you bother with a ceremony in VA. It seems like you really want to get married at home, so I would just do that. The first ceremony would be your “real” wedding anyway, so if you did it this way your church ceremony wouldn’t technically be a wedding.

Yeah I'm a little confused. If you want to get married in PA, get married in PA, and get your marriage license in PA. Your state residency only determines if you pay the in or out-of-state rate for the marriage license fees. You can get married wherever you want.
