FH thought the ring was real... need HELP!

Oh boy where do I start. FH bought my ring set on ebay from a store, no used. I had no issue with that other than when things go wrong you have no where to take it. Well my stone came loose after 1 month. He contacted the seller and they shipped a new one. They said they were going to send a return shipping label. They didn't. Yesterday we noticed my replacement is 10K and the first ring was 14K. Also the diamonds on the band have separated. So pretty much he got screwed. The seller is no longer on e-bay but he was able to contact them and they pretty much said sucsk for you. Because it has been almost 6 months I don't think ebay will refund him and he paid via paypal so they wont dispute either. Also after inspection the original diamond was chipped which leads up to think its fake. FH tried to fix it an broke off one of the prongs. I love my ring, if it was CZ I really don't mind but I am afraid this will fall apart eventually. Oh man what should be do?!

    Yikes. I would say cut your losses, lesson learned that you don't buy diamonds on Ebay, and go to a real store and get a replacement. Pawn the other one.

    We just want our money back at this point. Because the item is no longer offered we cant dispute.

    How much did he pay for it? Did the seller actually claim the stone was a real diamond? I would take it to an appraiser to get it appraised and find out if the diamond is real. If the diamond is real, you can then look at getting a new setting from a jeweler. If the diamond is fake then he should continue to try to get his money back.

    We looked at the one that where the center diamond came out. 90% sure its fake. I don't know how much FH paid. My guess is in the $1000 range. I really have no clue but FH has no money to buy a new one. I really do love my ring too Smiley sad

    When FH first told me he bought it online my heart sank because I KNEW something like this would happen. He probably got a really good deal or so he thought.

    FH paid for a 14K white gold real diamond ring. We cant even open a claim to get our money back because of the timeframe. The store no longer has any inventory listed and in the last month had several reports of fake rings. Yep screwed and money gone.

    Did he pay with a credit card? Can you dispute it through them?

    Did you insure your ring?

    ETA: A good jeweler won't charge an appraisal fee to simply look at the stone to verify if it's real.

    Dispute through PayPal and the credit card company. Contact eBay via phone.

    Def try disputing it to get the money back. Also I'd take it to a pro just to be sure what kind it is (fake or real). Yeah I'd never make a large purchase through ebay..too much risk of getting scammed.

    Go to a jeweler to have it appraised and get a certificate of what the stone is - CZ or whatever - so you have PROOF. It doesn't really matter if you "think" it is fake - get the proof from a professional. Then dispute it any way you can - the seller, PayPal or your credit card company. If the seller claimed it was a real diamond and it isn't, that's fraud. Hopefully you have a copy of the ad.

    If the diamond is not real I'm pretty sure you could sue the seller for fraud.

    Too much time has passed for Ebay or Paypal to do anything - Paypal is 45 days and Ebay is 60 I believe. I am an Ebay seller and at this point, I do not think there is anything you can do. It also will not do any good to file a suit because you would have to go to whatever state/country the seller is located in to file. Was it an Asian seller? A lot of Chinese sellers do this - they open a shop and sell jewelry for 2 weeks then close. The jewelry is also junk - like the kind they put in those candles where you burn the candle and you get a "diamond" in the bottom. It is a scam, but after 6 months I don't think you can do anything.

    Post a picture of it OP - I do know quite a bit about this sort of thing. But like other posters said, any jeweler will be able to look at it and know immediately if it is fake.

    Thanks all, we realize now there is nothing we can do. FH spent around $500 for what should be a ring costing $2-$3 thousand. Did he expect to be getting what he paid for? I just love my ring and probably will wear the 10K one until I can afford to have a specially made one just like it.

    Another thing to consider - if the seller advertised it as real and it's a fake AND it was shipped via USPS, that constitutes mail fraud which is a federal offense.

    Yikes! No advice but I hope you can get your money back. This sort of thing is exactly why I won't do large purchases online. Can't trust anybody..

    I think it's weird that FH bought a ring off eBay for thousands of dollars. And this whole thing seems sketchy.

    However, diamonds can crack/chip. Did your husband get the diamond certificate (any diamond over .19 no longer counts as a melle diamond and should have a certificate)? This is why there are problems when you buy cheaper stones. Not all diamonds are created equally. Let's say the stone your husban bought had had inclusions in it. If an inclusion is "fixed" so it is a "better" grade of diamond they laser drill it and then fill it, much like a pothole. However, much like a pothole they can crack because of ot etc.

    Also, if you hit your stone hard enough even with a diamond it can crack. However, I have clients at work (I sell diamonds) who are super rough with their jewelry and though it will show minor wear it hasn't completely cracked, especially not in 6 months.

    So your diamond might actually be a diamond, but it may be a poor quality which caused the chip/crack once you hit it on something. (Because your prong was lose that would only happen if you hit it on something without noticing) but a good quality diamond wouldn't chip with one hit, maybe a small diamond, but not a center stone.
