Would You Sign a Prenup?

The Bride, on July 17, 2019 at 8:59 AM

A prenuptial agreement aka prenup is an agreement that is entered into by a future married couple that lays out certain financial obligations and terms that the parties will abide by during the marriage and in the event of a divorce. Would you sign a prenup? Why or why not?

I think that the vast majority of people don't need one. We didn't sign one, but I wouldn't have had a problem with it if it was something that made sense (like if one of us owned a business, owned a lot of property, lots of material wealth). We are not above tragedy. Nobody goes into marriage thinking they will get divorced, but roughly 40% of first-time marriages end in divorce (and multiple marriage divorce rates only go up from there).

I didn't sign one, but I certainly would if requested. Perhaps it just helps validate for the family or future spouse that you are, indeed, only there for them. Perhaps it mitigates a fear. A couple doesn't need to view things as any less 'forever,' but if either one of us found it more comforting, who is the other person to strip away that security blanket?

My husband is an artist, and if he had asked for a prenup, I would have gladly signed one for him. I'd consider it a piece of mind gift.

I did. This is the second time around for both of us (so we know that life happens), he owns a business and has 2 children, and I came into this with assets as well, so for us it made sense.

That said....our divorces were not initiated by either of us and we both feel strongly about what commitment means, so the very first provision in ours says that neither party can initiate divorce proceedings without a good faith attempt at counseling. I would probably cringe at the thought of prenups for most young, first marriages, but every situation is different, and in some they make perfect sense.

I 100% would. It's not a predictor of divorce, it's being smart in this day and age. Just my opinion. I asked my FH if he wanted to sign one because he makes a lot more money than I do so really it would protect himself just in case, but he said no lol.

That seems like a fair alternative to a prenup.

Preparing for the worst-case scenario I guess.

Considering your experience, why aren't you signing one?

I don’t have any significant material or financial assets that I feel like I need to protect.

I can see why a prenup made sense for your marriage.

Oh no! What do you mean? Your 1/2 of the marriage, you do have a choice.
