Vendor Issue! Please help

Hello! I am going to try and make a very long story short! Our wedding was postponed and then we were asked to postpone again which we just can't do. We have some immediate family coming to visit so we are having a backyard party still to celebrate (we covid eloped lol).


When the wedding was canceled we reach out to our vendors to cancel. Our photographer who was paid in full called and went on and on for and hour and a half to tell me she cannot refund me any money and they'll "take pictures of whatever I want." It was a very very unprofessional conversation and I was extremely uncomfortable the entire time. After a couple days of think I reached out again and asked that either an offer be drawn up and signed for future picture sessions or we will have to ask that she come to the backyard party because i cannot just walk away and let her keep the almost $3500 i paid without her doing a service or attempting to make things right. She read the message. After so many days I said "hello" and she read that as well (Facebook messenger). Our party is in 4 days on Friday 8/14 and she still has not responded. What can I do?! What are my options?! At this point after the things she said on the phone and amongst others I don't even want her to come.

    Are you postponing your wedding where you can postpone with her? I hate to say this but I know most vendors due to corona and the fact they need to sustain themselves they are not refunding. Also, if you have a legally binding contract they are within the right. Since you said you cannot postpone again, whether or not you want her to be there, you paid so I would at least get nice pics. Have you thought of doing the ceremony in a beautiful park or something for nice pics?

    How important is it to you that she takes those pictures? If it’s not a big deal to you I’d just send her the details. (Location & time & date) if she doesn’t show you can then take her to small claims court

    There is no ceremony because we did the elopement. We do have a contract but there is nothing in the contract about it being non refundable. At least 50% was due at the time we booked and we paid in full to take advantage of a $300 discount. So I would think she would have the right to keep the 50% deposit and return the rest of the money is that wrong of me?

    Ahhhhh well if there is nothing saying that you are not to be refunded the other 50% then yeah I would dispute that. What are her reasons for not refunding the half if you cancel?

    One option would be you have to get legal matters involved but that is money on your end to dispute the contract.
