Paid in full but still haven't gotten the photos after 4months

I'm having problems with getting my photos and video from the wedding. Everything was paid in full as required. The photographer sent us a link with the nonedited pictures and POOF written across each one. He wanted to know if I wanted all the pictures or just a handful. I confirmed that I wanted...

I'm having problems with getting my photos and video from the wedding. Everything was paid in full as required. The photographer sent us a link with the nonedited pictures and POOF written across each one. He wanted to know if I wanted all the pictures or just a handful. I confirmed that I wanted all (because it was cheaper as a package). 2 months after the wedding he told me that it would only take about 2 days to edit them but with how busy he is it will take about a month for them to get to me. I was surprised that he still didn't work on them in those 2 months but went with his new time line. That month has come and past. I can't get a hold of him, don't have my pictures and he has a lot of my money. What do I do? The videographer that works with him but was paid separately and talks directly to me is doing the same thing. 3months after the wedding he responded to me through email that he is working on it but has a lot of work this season so it will take a bit. 4months and counting

    @JSARGE is right about the Intellectual Property

    If you still cant get a hold of him then I would contact your venue. Dont complain as much as tell them what going on and ask them if they have any information on how to contact him. It will let them be aware what is going on with out you sounding like a bitch.

    I'd be a little annoyed but I would reach out to them. Do you have a phone number for them try calling

    Use firm but non-threatening language. You are "very concerned" that after 4 months you have neither pics nor a firm delivery date for them. And that the photographer has not responded to attempts to contact them. The venue should be able to goose them into action.

    Getting lawyers involved and posting bad reviews, BBB complaints etc should be an absolute last resort, after you've given up on getting the photos back at all.

    I would say you'd like to give him positive reviews but are unable to do so if you do not receive your pictures immediately, if not sooner.

    What was said in the contract, and what goofs post unfinished proofs online? Most pros would finish the photos and then place on a proof gallery and release to the client, in the time allotted in the contract. How have you tried to get a hold of them? Did you call them? Visit them at their last known address? Certified mail? Whatever you've been doing is ineffective. More info is needed.

    It's odd a venue would hold the contract for the photographer and videographer.....and the footage is their intellectual property to use for their marketing and advertising, you are sharing usage with them....and are you saying you have no files? Examples like this are why shortcuts and joe blows aren't the answer. No one educated you on the process which is horrible, and they don't know what they're doing themselves.

    The problem with all-inclusives. You should have individual contracts with each subcontractor vendor. The person planning the all-inclusive for you, whether a planner or a venue, really has no control over independent contractors, unless they had the forethought to have a contract with them.

    For those having all-inclusives, you really need to look at your contracts. As a planner, while I do bundle the total price together, the wedding couple is still signing individual contracts, and my contract states the same, that I do not have liability for the non-performance of the subcontractors.

    But all contracts should state exactly what is covered, for how much, by whom, and delivery. And, what happens if that doesn't happen.

    I'm sorry. I'm with Nancy; send certified letters to the planner/venue, the photographer, and videographer, and give them a due date - quote the contract if it states it. And let them know if they don't perform by that date, you'll be taking them to small claims court.

    Another option is to look into your Attorney General's office. I know ours (WV) is very pro-consumer and they offer their services free in disputes like this. I used them in a matter when I paid for a product and didn't receive it timely, they acted as mediators. And as a lawyer, I've found that most people respond a little better when they get a letter or call from a government agency.
