Need Advice For Wrong Food Delivered To Wedding

Hi everyone,

I recently had my wedding and at the reception, the caterer brought a completely different menu that was agreed upon. On top of that, they charged us for a coffee station that was not provided. So more than half the menu was incorrect and we also got charged for something not delivered.

The catering company is willing to give us back the money for the item that was missed a 2% of the total cost for the other 8 mistakes. Has anyone ever been in this situation? Any advice on how to best handle this situation would be greatly appreciated.

    Depending on the specifics of the contract, I would likely argue that they were in breach of contract and request a full refund (probably accepting something a little less). But what they offered sounds like a very lowball offer.

    I agree with Hannah. They did not provide you with the menu that you paid for. You also mentioned that they had 8 mistakes (in addition to charging for something that wasn't provided) - that's a lot of errors! If they listed the specific menu in your contract (or depending on what's in the contract), I think that asking for a full refund would be reasonable in this situation.

    You can ask for a full refund on the basis of breach of contract. If the problem continues, you could mention that you would like to do this without going to court -- but don't say you would go to court unless you are fully prepared to do that.

    My research on this is that a small claims suits are available. But the evidence has to be convincing. The contract has to show what is expected. If some details are not explicit (like the menu items), the emails would have to show approval of the menu. Then, evidence would have to be included, such a pictures and the other side's confessions (as in emails) that show the deficiencies. If the case is sufficiently argued, the judge may decide on the equitable solution.

    Of course, the lawsuits can be a painful process. Hopefully, the caterer will give a significant refund.

    Definitely need to look at the contract. Specifics are very important in your case. Make sure you have written and photographic documentation. Without documentation, it is “He said, she said.” You need evidence. Good luck to you!
