Maide name as middle name not allowed in CA?

I read an article that says California (along with New Jersey, New York, Ohio & Pennsylvania) is one of the states that does not allow making your maiden name your middle name after the wedding. It would require a legal name change. "a legal name change, which requires petitioning for a court order and running ads in local papers notifying the public of the change, and can cost $100 to $400 total."

Is this true? I was hoping to take FH's last name while moving my maiden to middle name. I do not have a middle name. Anyone have experience with this?

    I know a few people who have had to do this. My aunt is unable to get a CA driver's license because of this. She's been married too many times and when returning to CA couldn't remember or find the paperwork for which marriage she changed her name. She decided it was easier to not drive than contact her ex to find out where they married to get the correct paperwork for the courts.

    I don't think it's technically "not allowed" in PA, but I do know several people who have had trouble with it - my mom being one of them. Her stuff still gets messed up after 30 years of marriage.

    Communist! Those states sound like their some of the worst for economic freedom. Not surprised. All about a women's right to choose...except for her own name. What bullshit!

    The best thing to do is to call the clerk of record in your state; in NJ it would be Trenton; all our licenses go through the town into the state office. Then call Social Security. For gay couples this used to be a REAL headache, since a wife could take a husbands name but visa versa required a legal name change. That's not the case now.

    I know at least in NY it is not considered a "name change due to marriage" and therefore you need to go through a separate name change process. Very very disappointing Smiley sad

    (FYI-- I got this info from the marriage application site. I'd check there first to confirm in your state).

    I am in so cal. My mom changed her maiden name to middle and dropped her original, granted this was 40 years ago. That is odd that they would makr you go through so much yet on the marriage license paperwork it asks what would be your middle name. I would contact your local county clerk office or get on their website. Also look up the Name Equality act of 2007. From what I read on it you can use your maiden name at birth as your new middle name without problem

    @OP - per my county clerk recorder office website:

    "Important: The Name Equality Act of 2007 allows applicants for a California marriage license to elect to change the middle or last names by which each party will be known after solemnization of the marriage. The elected names are entered on the marriage license when it is issued. Couples should give serious thought to what their married legal names will be before applying for a license. Changing a name after the license is issued (and before the couple marries) will require the purchase of a new license. Changing a name after the marriage is solemnized requires a court order and can be a lengthy, expensive process."

    Sounds like it should be easy as long as you put it on your license when it is issued. When you fill it out, the last part of the license gives either party the opportunity to declare their new name. Don't read these unofficial blogs - get your info from the actual government websites.

    This is probably irrelevant to you, but I live in Canada and I wanted to do the same and couldn't because of the same rules. It would be considered a legal name change not by marriage here as well.

    I kept my maiden name as my middle name for my first marriage. I was married in New Jersey. It was no problem whatsoever. I just went to the Social Security office.

    We got our marriage license in Vegas since that is where we will get married.

    I looked into it further (official websites) for my state and men can take their wife's last name with a regular name change due to marriage, but women cannot change their middle name through a name change due to marriage. It does require a legal name change that would be granted through the courts.

    Read your own sentence - you can do it at he time of the wedding. After, it just takes additional paperwork, it's not ILLEGAL, just takes more paperwork.

    And GameCox, we aren't anti economic freedom, we are pro workers. Political rant over.

    BTW, The info on pricing is dated! FH just finished a legal name change, And it was $600 total.

    Are you not in California? Because per my previous comment, yes, women CAN change their middle name at the time of marriage. That came directly from the county recorder's office website.
