Ex Wife sent a MC-050 regarding their divorce to my husband??

Osiris, on October 15, 2012 at 9:04 PM Posted in Planning 0 12

Hello ladies I haven’t been on this for a while....well the last time I got on I posted regarding my husband’s divorce papers, he got divorce in 99 but for some reason we couldn’t find his divorce papers so I was so worried that he may still be married to her, fortunately he was officially divorced in 99 we just weren’t looking in the right court house...now we get a MC-050 form stating she now has an attorney and she signed with her married name which is my husband’s last name??? and it says "Case RE Last Name Blank Marriage" IDK what this is I google it and I find nothing, can she reopen her marriage? or do something about her divorce or am I just worrying about nothing?

MC-050 form is need to notify appropriate parties of the change in a Petitioner/Respondent or Plaintiff/Defendant attorney's involved in a Family Law, civil case or possibly in Probate Law (Without Court Order) so as to show the termination of an attorney client relationship or the establishment of a new one has or is occurring (assuming a case is in progress). This is a formal process to allow a dismissed attorney to claim one additional fee from their client and may be filed by the client and is usually submitted with a proof of mail form to show service or notice.

This is what I found when I googled what is a MC-050

Here is a link to a Q&A lawyer page. This person asks about receiving this same paper 12 months after their divorce was final and a lawyer answered his question. Might be helpful.

It kinda sounds like she may be trying to go back after him for something. In there it says that she seeks council from that point on. I wouldn't post this in the wedding stuff. I'd call an actual lawyer. Maybe she's upset he's getting married and is trying to be difficult. And yes you'd get it after 12 years if it still involved him.

I agree on at least consulting with a lawyer. I wouldn't want to take any chances..It's a shame she isn't being clear on what she means..maybe her lawyer told her to sign with that last name so it matched stuff? idk.

Is she just changing her last name back?

Maybe she just didn't change her name back. A lot of women don't change their name back to their maiden name if they are established in their career.

If your DH has a retirement plan, she may be have hired a new attorney to assist with a QDRO (Qualified Domestic Relations Orders) This happens a lot as most family law attorneys do not involve themselves in QDROs. Normally, the new attorney's name and information are on the form. Have DH contact his attorney and advise of the new information.
