Does anyone have a foreign fiance

Karin, on August 3, 2016 at 1:13 PM Posted in Planning 0 27

My fiance is foreign and we just submitted paperwork to get a K1 fiance visa. Just wondering if anyone else is going through this process.

Hey Karin! I have a foreign husband, we were able to skip the fiance visa process because we lived abroad at the time but we did have to go through the greencard approval process, so I feel your bureaucracy pain! Read everything carefully, photocopy everything, consult an immigration lawyer if you ever have questions, and stay patient, you'll get through it. I wish you lots of luck!

I'm the foreign fiancee myself Smiley smile But luckily, I was already in the states on a J1 (work) visa.

Make sure to talk to a lawyer and triple check everything before sending it. and as Jo mentions, keep photocopies of everything you send, so you have proof that you sent it.

FSIL's husband is from Costa Rica and they went through this process! She planned an awesome wedding in 3 months, it was nuts!

Like pps have said, triple-check everything, keep copies, and follow up a lot!

Hi, most K1 visa processing is faster than any other visas so long as you have all the requiered and complete docs needed. Smiley smile Mine took 5 months.. Smiley smile Worth the wait Smiley smile

My fiancé is Australian and were in the middle of the k1 process! We just got our NOA2 approved a month ago (only 2 months after we submitted). We were so surprised since the timeline online said they were currently taking 5 months. He paid the fee a few days ago and they are supposed to send him a packet of everything he needs to do before his interview and when the date will be!

The biggest thing for us was getting everything done for the I129F... I was such a perfectionist and worked on it for a month straight making sure everything was just right and we had more than enough evidence. We didn't go through an immigration lawyer but we did tons of research on the website and on forums from other people who went through the process.

Where is your fiancé from and how far are you along in the process?

If you need any help or have any questions I'd be happy to help however I can! Smiley smile

Also if anyone has gone through the interview process and changing status from visa to green card...I'm interested in hearing your experience?

@Misis A. When you received your NOA2 and requested a date for interview how far away was it? Were you able to change it if needed?

After you get married and submit everything did they give you an estimate on how long it will take to get your status adjusted/ability to work? Are you able to apply for jobs before then and say when you'll be getting it?

Sorry for the question overload! And totally don't mean to hijack this thread!

Got a foreign hubby (from Spain) now but we were (and still are) living in Spain at the time we got married (wedding and legal marriage was in the US). Because we didn't have any intention of staying in the US he just entered on a regular tourist visa.

An american girlfriend of mine who also lives here and recently married a spaniard also, they're now starting his greencard process, she found it easier to legally marry in Spain and then bring him over as her husband vs. fiancé.

@Dani There's also visajourney.com It's been extremely helpful with information about timelines and processing times and steps about AOS, getting a social security card, green cards, etc.

@Karin - My DH is from Scotland and came over on a K1. We are just about to mail off his AOS package today, actually. The K1 process was so nerve-wracking. We were so scared that something would go wrong and he would get denied. What I've learned, though, is that if you're careful to make sure you have ALL of the documentation you need, are legally allowed to marry, then you shouldn't have any trouble. FH sailed through the process. I'd also recommend that you provide more than the required evidence of an ongoing relationship. Some people barely look at it and others comb through it. Better to have too much evidence than not enough! I wish you the best of luck!

Oh also, this site was invaluable! I used their checklist when sending off our packages. Did the same for the AOS as well. There are forums too and great people who will give you answers right away.

FH is from Guyana, I too was born and raised there. We skipped the fiance visa because we want to get married there, most of our families live there. We're in a LDR ( this year is so tough) but I visited him about 5 months ago and I won't see him again until our wedding next year. Then we will apply for a green card for him. Good luck.

@Mrs. Mac - congratulations on your marriage!! It's so relieving to see other people getting through this process!

What kind of evidence did your husband bring to the interview? We made a huge binder of the originals of all our stuff we submitted in the I129F - (boarding passes, letters) + boarding passes from our recent visit after we submitted the packet, tons of additional pictures, letters, cards.

We submitted a copy of our venue contract in the original packet and I was planning on adding any more contracts/a save the date to the binder as well.

Does that seem like enough or what kind of things did you do for the "ongoing" relationship?

@Dani - Thank you. Smiley smile That seems like more than enough and it sounds like you guys have your bases covered. I sent him to his interview with our most recent boarding passes for trips that occurred after we submitted the I-129F as well as photos from those subsequent visits. He also took the copy of our venue contract. He said that the interviewer did look through them but very briefly and didn't pay much attention. Do you have the Affidavit of Support ready? They don't really pay too much attention to that other than to check to make sure your income meets the requirements. I just sent an employer letter and 2 months of pay stubs. No tax returns. The Affidavit for AOS is much more detailed and I had to send all of that plus tax returns.

@Dani - I just heard about things 2nd hand from FSIL so don't take too much stock in my story! FSIL was totally underwhelmed by the interview - one of the questions they asked her (now) husband was if she has any siblings and what their names are. It was easy stuff. She was SO prepared though! She had printed out records of all of their Skype calls and FB pictures together. Always better to be over-prepared Smiley smile

@Mrs Mac Awesome! Thanks! So the affidavit is kind of what I'm nervous about...I'm a physician assistant student about to graduate with my masters in December. So currently, I don't have an income. My fiancé is out of college and has a good job and savings. I'll start applying for jobs soon and hope to start working immediately after we get back from our honeymoon in April, but we plan to use his savings for the first month or so. (I live in AR, parents and wedding are in AZ..I plan to come back to AZ December until wedding and fiancé plans to come Feb till wedding so we can spend time with family and plan). We researched and it said I'd need a co sponsor, so my dad graciously agreed to fill out the affidavit as a cosponsor and put all his forms together for us. And explained that he's willing to provide room and board for a year (if needed...even though he won't be). I put 0 income on mine and my plans.

We searched on the forums and didn't really hear about anyone having issues for using a cosponsor. But you felt like they weren't super strict looking at the affidavit?

How soon after you get married do you need to submit the affidavit for AOS?

Shoot. This is making me feel like I might need to try and start working earlier :/ do you know if you can use a cosponsor and then change it as soon as you get tax returns and things?

Sorry for the information overload! I so appreciate your help!
