Canadian getting married in Hawaii!! :)

Kristin, on January 27, 2013 at 11:39 PM Posted in Planning 0 5

Hi all,

I have a quick question about legalities about getting married in another country. I am Canadian, my fiance is Australian and we are getting married in Hawaii....other than the marriace license, does any know if you require any other documents or things in place in order to make sure we are legally married in Canada (where we live)? Of course, we are having an authorized officiant perform the ceremony adn will have our marriage certificate, but is there anything else I need to do? Just making sure I cover my basis!!

Thanks guys,

K

Will the Canadian government recognize my foreign marriage?

Generally, your foreign marriage will be recognized by the Canadian government, if the marriage:

Is legal according to the laws of the place where it occurred; and

Complies with Canada's federal laws on marriage.

According to Canada's federal laws on marriage:

Close relatives by blood or adoption (grandparent-grandchild, parent-child, brothers-sisters) cannot marry each other.

You can be married to only 1 person at a time.

You can find more information about how CIC evaluates foreign marriages in sections 5.27-5.32 of OP 2-Processing Members of the Family Class

I found the above information by googling it. You need the marriage license and a licensed marriage officiant to get married in Hawaii. Check the laws in Canada but from what I read, if the marriage is legal where it took place, it is legal in Canada.

Here in Fla., I've married many couples from Canada and other countries. To get a Fla. marriage license you both need to appear at any county courthouse in Fla. with your photo IDs and dates any previous marriages ended. US residents must also provide their Soc. Sec. numbers.

Thank you both for your responses.

I know I need a marriage license and am having a licensed officiant marry us, I was just checking if there was anything else I may need that I did not know about. Glad to hear that it will be just that!

    Thanks again,

    Kristin

Here is a really great step by step guide on how the Hawaii Marriage license process works. http://blog.simplemauiwedding.net/2015/12/hawaii-marriage-license-guide-faq.html

The guide gives you a full step by step process of what needs to be done and when it needs to be done by and information for those from out of country. Think of it as the Cliff Notes of what the state has thrown out there plus links to all the state information on Hawaii marriage licenses and civil unions with a great FAQ.
