I had to cancel my wedding; the venues closed, I had a military travel ban, and we were doing an out of state wedding during the COVID-19 outbreak.
We cancelled March 20th and our wedding was April 4th. All of my vendors have been wonderful and have refunded all money (minus deposits, rightfully so) with the exception of my makeup artist.
We paid $1600, and had only received emails and a wedding day timeline (hadn’t even discussed a look for my day). She’s refusing to refund any of the money stating that I didn’t cancel my wedding within our 30 contractual agreement. Her business and state were on shutdown on March 18, leaving her unable to fulfill her side of the contract. I’ve offered her to keep the $500 deposit and installment payments of the rest but she stated she could only refund 600$ and the other vendors only refunded money because they provide “day of services”..........
My next step is to contact small claims court, just looking for some friendly advice please.

    Covid-19 is considered an act of God I believe... definitely take her to court! This makes me mad!

    BELIEVE IT OR NOT, I'M CURRENTLY IN THE SAME SITUATION WITH A VENDOR. THEY WERE VERY UNPROFESSIONAL. THE COUPLE REFUSED TO GIVE OUR MONEY BACK AND THIS HAPPENED BEFORE THE CONVID-19 HIT. NOW WE ARE FORCE TO TAKE THEM TO COURT. IT HORRIBLE GOING THROUGH THIS RIGHT NOW. I COMPLETELY UNDERSTAND ABOUT THE CURRENT SITUATION BUT HONESTLY YOU HAVE DONE ALL THE RIGHT THINGS. I THINK SHE SHOULD HAVE BEEN HONEST WITH YOU ABOUT NOT BEING ABLE TO PAY YOU BACK RIGHT NOW.

    Hi Tara! Unless she has a force majeure in her contract you are legally entitled to all of your money back including deposit. The reality is that she probably already spent the money you gave her and can’t pay you back. Of course, that is no excuse. If you paid via credit card or personal check you can dispute the charge. That is my best suggestion to try to recover your money.

    I would definitely pursue legal action. My vendors would not refund me my deposits if we cancelled. We were able to postpone and transfer our deposits to a different date. I ended up fully canceling my MUA because I was not happy with the makeup trial, so I simply did not ask for her to transfer us to a different date, I just told her the wedding was cancelled and even with that being said I did not get my deposit. I did however get some money refunded only because I paid in full for my bridal makeup. So she withheld the bridal makeup deposit + 2 bridesmaids but I got the remainder of my bridal makeup back. The contract said non refundable deposit and did not have act of God clause. I tried to bargain for my MUA to only keep 50% of the deposit and she wouldn’t budge. (I guess we could say even though its NOT our fault we have to cancel, its still a cancellation in itself)


    If I were you I would seek legal consult because it may be right for her to keep ur deposit if its non refundable but its not right for her to keep the rest of the money for a service that you never received. Telling you it’s costing her money to email you is ridiculous and I wonder how many other ppl is she doing this to. Sorry ur going through this.

    The acts of God clause is key!! We need to raise awareness about this issue! Couples are being extorted and forced to pay transfer fees and additional deposits to move their dates. Everyone needs to know their rights! If it doesn't say in the contract that you will be imposed a fee, then you should not have to pay it. These vendors and venues are taking advantage of the situation, and preying on desperate, emotional brides who just want to get married. This is wrong!


    We took legal action and had a family attorney write up a letter, and we sent it to the venue. Do not let vendors take advantage of you!

    We had a family attorney write my venue a letter and called them out. We cannot let vendors take advantage of this situation! Brides are desperate to get married and are being extorted and forced to pay extra fees that are NOT stated in the legal binding contract. My venue wanted to charge me $2500 to change my date to June 20, 2021, Same date, but next year.

    She does not sound like she will budge. She could not legally fulfill her contract (being shutdown), I would say, she definitely owes you the amount back. There was no way she was going to be able to service you on that date. Ugh, I'm so sorry you are dealing with this. I'd definitely think it will have to brought to court, unfortunately, but I would not let it go. maybe knowing legal action is coming, she will pay up. Best of Luck!

    I want to be sure that I understand. You cancelled your wedding within 2 weeks of the date? And the venue was closed? The issue I think will be that she was still able to provide service and you could have moved the location? Or downsized, etc. In the end, what I am noticing is that if you can have a wedding in some way - or even just one way (5 people with masks, and no food) then it is still considered a choice if you opt not to do so. I know that sounds insane.

    I've really learned that moving things early helps most with vendors being flexible. I'd speak to an attorney - but be mindful that it will likely cost more than 1k to sue. I'd take the $600 and be done.

    I would certainly present your evidence to a lawyer for legal counsel, also let her know that you will be speaking to your attorney on how to handle the situation. $1,600 is a fairly large sum of money to loose out on.

    In times like these people can either do the right thing, or the selfish thing. How on earth she can possibly justify keeping $1600 is beyond me. We are all always worried about being nice. Then there's the time issue and who has time for small claims court.

    Just do it. Tell her you are going to sue her in small claims court (you'll win!) and that you also plan to review her on every online option available to share your experience.

    There is a time to be "nice" and there is a time to back the bully down. Great luck! p.s. I can't even believe she is acting like such a hag during this time with ZERO empathy or caring toward the brides who keep her life going. I'll stop here. Disgusting!

    WHAT? Seriously. Please, PLEASE do not try and make this bride feel guilty like she owes this woman free $$. Seriously? OMG. You think she should DONATE $1600 to her make up artist? I'll stop here. The makeup artist may well be more financially secure than the bride. Maybe the bride will end up in bankruptcy! STOP.
