What should be addressed in a caterer contract?

Our caterer is a local, well-established butcher shop (we are doing a BBQ buffet-style dinner). They cater events all the time, but it appears they aren't accustomed to using contracts. FH has been bugging them about getting us a contract, and last week he came home with a handwritten piece of paper that simply listed all the foods we agreed on and a total price.

FH, being a guy, doesn't see the problem with a "handshake" agreement, but I want a legit contract, especially with the business providing our food! So I need to go back to them with a specific list of what needs to be in the contract, or draw one up myself. So for those of you who have one, what is included in the contract?

    If a deposit is to be paid, payment terms. Vendor plates (like a wedding planner, dj, etc) the foods listed, and condiments, Beverages. Who their contact person will be. Delivery or pick up times. Anything you specifically want from them that day should be detailed in the contract.

    Thank you! Do you know if they typically include anything about if they have to cancel- i.e. Contingency plans, refund, etc, or is that implied by the presence of a contract?

    I would type up/download a sample contract, bring it to them, and have a conversation to find a middle ground on what will be included in the contract. Have all edits written out on the 1st draft and initialed and dated by you and the person you meet with. Then re-type it up with the agreed-upon terms and have it signed; I would give them the original and keep a copy for yourself.

    Anything written and signed implies a contract and will hold up in court. Have him include: Event date, time of delivery, all food included, Any serve wear, if they are providing servers, include all details, prices, deposit you paid, total amount due and when that total is due, payment types accepted. I doubt very much they will give you a contingency plan.
