What Can i Do!

Lisa, on December 14, 2020 at 9:18 PM Posted in Wedding Attire 0 10
I’ve been screwed over by Pronovias regarding my wedding dress and they have so far passive aggressively refused to refund me. I don’t know what rights I have or where to go with this besides the internet.

Short story, it’s been 9 months of limbo, back and forth phone and email communication, with them “reviewing” how they shipped my dress to me without finishing the agreed upon alterations and in my opinion ruining the dress physically and emotionally for me.
Anybody got some good advice how to deal with an international company from afar during Covid?

The designer itself or a shop that carries the line? Most designers, even top names, do not sell dresses directly from factory to customer. Talk to a local lawyer and see what your options are.

The flagship store in NYC for the design house. I have been dealing with their corporate office in Barcelona since the dress arrived because I had a line of communication open with them already as this was not their first time screwing up. And corporate could care less.

I can’t tell you what your rights are because they depend on the jurisdiction and Pronovias’ applicable terms and conditions, so I can only speak from a general point of view. If you ordered a product and what they delivered is different to what you purchased, or has been materially altered, then generally speaking, yes, you should be entitled to a refund, or, depending on the extent of the departure from what you ordered vs what you got, at the very least, a partial refund or replacement product.

As a lawyer for a company, I will tell you this much, if you respond to them that you haven’t received a response / are yet to be provided with the remedies you reasonably requested, and that you will be making formal complaints against them in the applicable consumer bodies (I don’t know of any where you live but where I am we have a few such as Fair Trading and the Competition and Consumer Commission, they may be more likely to respond to you and fast. Companies hate dealing with those type of complaints and they generally will be more intent on resolving the matter before it escalates to such a point.

If the product was sent to you not the way you ordered it then you should be able to get a refund.

I know someone who purchased their dress from Kleinfeld and NEVER got it. She contacted so many people and no one could help her. She ended up calling her credit card company and explaining what happened so she was refunded that way. Best of luck ♥️♥️♥️♥️

Thank you for the advice. I have done some research and submitted complaints to local agencies where the flagship store is and also in the country of the headquarters. They were not at all phased by me saying I was going to follow that route. Still I certainly appreciate your advice and it gave me another Avenue to pursue. Fingers crossed ** The agencies can assist. 🤞🏻

Honestly pursuing remedies at law is a nightmare (even for me!) – I myself have a similar dispute with a company that I have escalated to consumer agencies in an attempt to have it resolved, but, it’s always good (and cost effective) to exhaust all free resources before pursuing action further in a court or tribunal. Hopefully once the complaint is formally received by Pronovias they will get their act together! Good luck 😊

I’d love to but only one part was paid by CC and that was from May 2019 when I originally ordered the dress. I’m not sure if it’s been too long to dispute the charge.

Can't hurt to ask. Quarantine had me buying stuff from sketchy Facebook ads, some of which I never got, and I was able to dispute the charges and be refunded fairly easily. Good luck!
