Wedding Venue asking full absolute rights for photographs and video

27. Usage Rights: Client hereby grants TRADEMARK the absolute right and permission to take and use a photograph(s) and or video(s) of Client in its promotional materials. Client releases TRADEMARK, the photographer, their offices, employees, agents, and designees from liability for any violation of any personal or proprietary right Client may have in connections with such use.

This is what my venue had in the contract. My fiancé and I have not signed anything as we need to revise this into something more approving to us.

It doesn't seem fair for them to receive high resolution quality pictures and video from our photographer as we will be the ones paying for them and our photographer spending his time in working on them and making them perfect. Seems fit for me that if the venue wants to use them for promotional purposes they should hire their own photographer and pay them to do so with approval of the bride and groom.

No ONE likes to work for free and photographers are not always given the credit and pay they rightfully deserve for all their hard work. How can I ask them to change it or simply take it out without coming off as rude or offensive?

    Our venue had something like this on it, but the photographer and venue have an established work relationship. I would run this by your photographer before you ask them to change it. It may be a common standard in the area.

    Thank you! My photographer is separate from the preferred vendors list and he is a professional but he is also family. When he said he didn't approve unless he was being payed from them for the photos. I'm currently waiting on the videographer since he is his friend so I'm not quite sure if he will be on the same page. I did catch that though at first the guider I was given said I could use my own separate vendors but in the contract it states that it has to be their preferred vendors list for everything. So I am a bit worried now for a lot of things from the venue. But I'll definitely speak to them and see what we could work out.

    I don’t think it’s unreasonable for them to want photos, but I would try and make it say that the photos provided will be of your choosing, and that the photographer must be given credit wherever they are used. Sounds to me like they’re trying to generate free advertising for themselves which isn’t really right. Just my opinion and I think a good compromise!

    Honestly, I can see where they need permission to use photo’s of you, but the photos are the copyright of the photographer. They should get permission from them as well.

    The way I read it is that they - The Venue - have the right to photograph and video you, and use that in promotional materials if they want (i.e "to TAKE and use". I don't think it means they have rights to your professional photographer's photos. So that would be the question I would seek clarification on. We have a similar clause in our contract allowing the venue to photograph/video us, I think it's pretty standard. Has nothing to do with our third party professional photographer.

    Either way, I guess one thing you have to ask yourself is if you want to be the poster child for this venue?

    Yeah, I think you are reading this wrong. It's not for the venue to have access to your professional photos taken by the photographer you hire. This is a clause that gives them the right to photograph you, and to use those photos on their promotional materials if they choose.

    This isn't connected to your photographer at all. It just means that if you see a venue photographer walking around the day of taking pics, you've already agreed to allow that. It's really no big deal, and shouldn't impact your wedding at all.

    Not wanting your photos plastered everywhere without your knowledge is a perfectly valid reason to ask the venue to remove that clause. Some people are more private, many people want to have some control over where their most intimate photos are shown. I asked my photographer to cross out the model release and he was fine with it. It's a common request.

    I definitely could wrong but if this is the venue contract (ie TRADEMARK represents the venue) I think they are suggesting that were they to take any photos or video at your wedding they would be their property and they wouldn’t be giving you copies. I would follow up with your venue though to make sure.

    Thank you all for your help and suggestions!

    For anyone going through a similar matter as mine this is what i responded:

    We do not agree with giving our rights and permission and use a photographer’s videos or photographs. I have also been looking into many photographers and videographers and they informed me that this policy cannot be enforced as many of them spend a lot of time and get paid to release this material and that they are not comfortable with having to release them for free promotional materials. We do not release TRADEMARK the photographer, their offices, employees, agents, and designees from liability for any violation of any personal or proprietary right

    If trademark would like access to this we would like to be asked and decide which pictures and videos could be used as they are valuable to us both and should not be required to give up our rights for these.

    As well as for our photographer if he so wishes to be paid for by TRADEMARK and chooses to realese any photographs or videos would be with the permission of Brandon and Elmarose.

    My venue did say that it was in regards to our photographers and did not specify hiring any photographers for that matter we decided to go through with this. I'll keep you guys updated on their response.
