Wedding Photos never received

Amber, on April 24, 2019 at 2:21 PM Posted in Etiquette and Advice 0 5
Here is my dilemma so I hope this discussion will help me gain some clarity on what I should do. I contacted a wedding wire photographer about my December 2018 wedding date in Colorado. We made the online payment, signed the contact, she showed up and the photos were taken at the event. It has now been almost five months and after calls, emails, and texts with multiple excuses I have no photos. No one took any photos of the event because she was there. This is my first wedding and at this point I don’t know where to proceed other than taking legal action. Has anyone had this happen to them? How should I proceed with this upsetting situation?

Oh Amber, I am so sorry to hear this. Yes, I think you will have to take legal action. Did she send you ANY photos at all?

Does she not answer any of your phone calls, texts, or emails? Have you tried FB messages or even posting or giving a bad review on her FB page or Wedding Wire page? A bad review explaining the situation might be enough to bring her out. Or if she has an office or you live close you could show up (should have a address in the contract).
Does the contract state how long it'll take to get photos back?

First you should read through your contract carefully and find a delivery date listed in there. Then you should reach out via email and say “per our contract our photos should have been delivered on x date. If they aren’t delivered by (date you choose in the near future) we will be seeking legal action.”

Does your contract state when you would get your photos by? It usually does. If so, I would send her another email and/or letter stating you have still not received the photos and that she is in breach of contract which stated you would receive them by x date. State to her that if he does not reply to you or deliver the photos by x date, you will be seeking legal action.

Exactly the response I was going to give. Unfortunately if it's not in your contract, they can drag it out as long as they feel necessary (which sucks, but it's not illegal) but if it's in your contract (as it should be) you should absolutely send one final, formal email. Give them the "one last chance" option, but make it clear that you're not screwing around and you are prepared to take legal action. I also agree that leaving some kind of a review (somewhat negative, obviously) is usually enough to draw vendors out of their hiding place. In an era of social media and instant info, many take a negative online presence more seriously than pleasing their actual clients.

Good luck! I Hope this works out for you!

What did the contract say about delivery date?
