Wedding Cater and refund

Hi! My fiance and I booked our cater a couple of months ago but just came across a new location that will ultimately be cheaper. We paid 500 as a deposit to the original cater. It states no where on my contract anything about cancellation policy or refunds. I just emailed them and they said deposit is non-refundable. Can I argue with this since it is not stated on the contract? Any input is helpful! Thanks in advance

    I’d recommend just re reading your contract to make sure there’s nothing stated. If you still don’t find anything then yes I would proceed to tell them you’d like a refund.

    I would re-read your contract or ask them to explicitly tell you where in your contract it said it was non-refundable. Usually deposits aren't refundable, especially when the reason is that you found another caterer.

    I don't think so, since it isn't stated anywhere they will return it. Usually a deposit is so you don't cancel on them, like an insurance policy for them.

    I’ve never seen a vendor (planned two weddings and several other birthday/holiday parties) that has refunded a deposit unless the vendor is the one who cancelled. Unless it explicitly states you get your deposit back in the event of cancellation, I don’t see why they would refund you.

    I would say since there is nothing in your contract that states the deposit may be refunded, then you shouldn't expect to get it back.

    Deposits are an insurance policy for both you and the caterer. Without there being some extenuating circumstance (you had to cancel the wedding, had an accident, etc) there is no reason that the caterer should consider giving you the deposit back. They keep that is compensation for the potential money they lost by holding that date for you and not letting someone else get it. Unfortunately I think you may just lose that money.
