Videographer Isn't Responding

Kasyah, on December 28, 2020 at 8:54 AM Posted in Etiquette and Advice 1 16
As if getting married in 2020 hasn't been a nightmare enough now I'm dealing with this... We were married back in July of this year and I have had hardly any communication from our videographer. We paid him in full the week we booked him back in January. He's actively posting on social media about new couples he is doing work for so that's also adding to my frustrations of the utter lack of professionalism to reply to someone who has paid in full for services.

This is the only vendor we have left to get something from so I emailed him in September asking for an update as to when we would receive the footage. Dude doesn't reply. I call him a week later and he said Outlook was having issues and officially down nationwide so that is why he didn't email me (complete BS bc I have clients who strictly use Outlook and had been in contact with them with no problems reported). Anyways, I ask him to give me a date we will have the footage by and he said November as he has already chosen the music. No biggie, we can wait a little longer I suppose. November has passed so I called two weeks ago and left a VM and then sent a follow up email and have still not heard back. It is now almost January and I am starting to think we have no video which is extremely heartbreaking since my parents couldn't make it and this was their one request.
Does anyone know what kind of lawyer I would talk to regarding this? I'm thinking a demand letter might help and if there is still no reply then on to small claims court. I'm trying my best to be courteous and give him the benefit of the doubt but the lack of communication is driving me insane. Thanks in advance for any insight provided.

I hope someone can provide better insight on exactly what legal action to take, I’m not familiar with specific proceedings but I definitely agree that there should be legal action taken immediately with his lack of communication.. Did he give you an estimated turnaround time when you first hired him? Was there a contract with that information stated?

He said when we booked him that his turnaround time was 8-10 weeks so we should have received something end of September/ first of October at the latest. I looked back at the contract (kept all of that and correspondence from emails) but all that was sent back from the digital contract was the basic information- date/time/his info/our info/amount of services/date paid and lastly we agreed to the terms and conditions. I tried opening the digital contract again for the terms and conditions to reference and it takes me to a broken link on his webpage. I remember clearly that in there it mentioned a time we would have our footage, unfortunately I can't seem to access it again.

I want to say this will go to small claims court but I would imagine that any kind of prosecuting attorney could look into this. Have you reached out to any attorneys about the situation cuz they can probably guide you best and if you have the contract on hand as well as the lines of communication through email as proof then you probably have a good case. Honestly it might just take a letter from a lawyer just to have a guy respond to you. For me before I decide to spend money on an attorney I would just do one more last ditch effort emailing him maybe even CC your husband and just say that you haven't heard anything he is well outside a contract boundaries for when the video should have been provided to you all and he has not been communicative. Also in the email I would probably state that if he chooses not to reply with an exact date of when the video is done and the video is not delivered by that date you may have to seek legal representation because of breach of contract.

Does your contract state anything about turnaround time? I can tell you it took our videographer almost a year to get us our wedding video because he was so far behind. I was about ready to pull my hair out when it came to dealing with our videographer. But our wedding video did turn out amazing!

I would start contacting him via DMs on IG, or leaving him comments on his IG asking him to contact you asap regarding your missing footage

I've thought of doing this so maybe he would respond. I've held out on leaving any bad reviews just because I am hoping he is just behind and will get us a good video like we paid for.

I think at this point the bad review is in your right. His professionalism is out the window and his desire to calm your anxiety is also non-existent so even if the video is amazing his customer service is terrible & if his outlook is having issues he should have offered a new email adress or something to make communication better

It doesn't say anything about turnaround time just that we would have all video from that day along with the 4-5 minute highlight video. But when deciding on a videographer we asked that question as it was very important to us. He told both my husband and I multiple times the turnaround was 8-10 weeks.

I get being busy but this is 2020 and he already mentioned many of his brides moved their date to 2021 so he definitely isn't as busy. I would think that would mean even quicker editing.

Thank you, I think I will try calling him again today and leaving another VM. I email him again too like you mentioned and proceed from there. Just floors me he had such great reviews.

I think without having the actual turnaround time in writing it would make it very difficult to sue him. It would end up being your word vs his so unless you have evidence of some kind that proves he told you 8-10 weeks the court might not take your side.

I think that if an unreasonable amount of time has passed with lack of any communication (which I can prove there is) then there shouldn't be an issue with the court staying he hands over the footage or he needs to reimburse us. You don't become unresponsive to a customer that has paid in full for services...

Consult with a small claims lawyer and the consumer reports team at the local news stations. Both of them can help you make some progress.

Hi just wanna ask you, did you end up getting your wedding video? we are on the same spot right now. Our wedding was last October 2020 and my Videographer (Cupid Brothers) is not responding. I tried so many times to contact Stephen and no responds till now.
I would just like to know what step did you do? I just need an advice from someone who has the same situation as me.
    Thank you so much.

Hey, girl! Sorry to hear you're going through the same. I called and left a voice-mail as well as an email the same day saying that if he didn't respond within 48 hours I saw no other choice but to take him to small claims court. I was going to file in May and low and behold out of nowhere it showed up in my inbox like nothing ever happened! Dude acted like nothing was wrong. We are glad we got it but it was super unprofessional. I've left a bad review on all platforms and all of my vendors I kept in contact with have told me they will not work with him again. Word of mouth is huge. I would say do the same- in writing is best for a paper trail. Let them know if you don't hear back by such and such a date you will proceed with legal action. A small claims court is your best option depending on what state you live in. Worth it to me though. Hope that helps!
