Venue going out of business

So we just had a crazy phone call with our venue, as if this could’ve gotten any worse. Basically, in NY 50-person weddings are allowed in Phase 4. Our wedding is in 6 weeks and the venue is still unable to provide us any info about other safety requirements and they can’t even tell me if a dance floor is allowed. Then today for the first time ever, we learn they are afraid of going out of business and the 2021 date I secured as a back-up is currently no longer an option because they are not writing up any more contracts for 2021 because they’re afraid they’re going under. Does anyone know what our rights are here? As of right now, they are not providing us with any services they’re supposed to and we have NO idea when our wedding date will be. If we cancel or they cancel, we need as much money back as possible.

    You would need to review your contracts. I would imagine they are in the right to cancel postponements but I would ask them will be in operations in 6 weeks. Good chance you will not be refunded but review the contract and if need be ask a lawyer.

    If they go out of business they have to fully recompense your entire event and what you paid for as soon as possible. You should also be given that option right now to pull back and get your money. I would get in contact with anyone else from the venue see if you can visit them in person. Worst case scenario that you don't want is for them to end up closing and you loose everything. Right now that you are aware it's best to get this solved asap. Best wishes, I'm very sorry for your misfortune but I'm sure your wedding day will be so much more special because you guys truly overcame a lot of obstacles Smiley cry Smiley heart

    If they file for bankruptcy there will be nothing you can do. They will not pay anyone until the court case settles and most people will get little or no refund. If they are this close to going down, they probably don't have the money to give you. I think even if you cancel and try to get your money back they just won't be able to do it. Hopefully, they can make it 6 weeks to your wedding but I wouldn't count on it.

    Unfortunately if they go under I don’t believe you will be able to get any money back. Our NY venue doesn’t know about dancing, etc but I see that as kind of a blessing because I’m afraid they will tell us that dance floors won’t be allowed...

    As others have said, I'd try to contact them and (as calmly as you can) try to get clarification on how this impacts you and what your options for refunds are. Try you best to stay calm (just for your own sanity) and mentally prepare yourself for some unpleasant news.

    But we’re paying our DJ a lot of money so am I supposed to show up that day and find out we have a Dj for pretty much nothing? This is crazy

    I would think you would know before your wedding day if they’re going out of business. For 2021 it sounds like they could go under but for this year no. You may be able to look at your contract to cancel and get your money back and book a date for 2021 someplace else. But if you’re moving forward with 2020 fingers crossed they stay afloat long enough for your wedding. I’m so sorry that you have this added stress right now, as if things weren’t difficult enough for us brides. Hope they stay in business and your big day is amazing Smiley heart

    Oh sorry I just realized you meant just the DJ. I would contact the DJ and see what the latest you can cancel is.

    There's no way for any of us to know what's going to happen in six weeks, unfortunately (which, of course, doesn't help your stress, I know). However, if you won't be able to have a dance floor, if won't be the venue's fault, if will be regulations that they have to follow if they want to even *try* to stay in business. I can't say I blame the venue for not signing contracts for next year if they're uncertain of their future.

    I would talk to your DJ about cancellations and other options.

    They still owe us an explanation on what is going on and what’s allowed! The situation is that they currently have all our money and are not providing us with ANY of the services we signed up for. I can’t believe how these businesses just get away with that scot-free. THEY should be the ones taking the fall for this, Corona is no one’s fault but it should not be the customers who just have to eat the loss

    They have no more information than you do about what will be allowed in 6 weeks. None. This is unprecedented. Additionally, it sounds like they *are* taking the fall. They told you that they may be going out of business. That's a heck of a fall to take. Furthermore, you say getting off scot-free - please remember that they are people too. They are looking to keep in business so they can pay their rent, feed their families, keep their employees in jobs.

    I understand that you are stressed and upset - but it is likely that this is a small business, not some big corporate enterprise. They're doing their best, which is all they can do.

    They’re not “taking the fall” when they’ve pocketed over $10k of my money and I have no wedding date to show it. That is messed up. Period. I cant understand having sympathy for big businesses that should have insurance. I’ve been out of work since March and I’m not pocketing other people’s money for no reason Smiley winking

    You have a wedding date in 6 weeks. They haven't cancelled. They are in trouble. You also are calling them a big business, but it doesn't sound like that's the case.
