Vendors and Covid

Cortney, on June 1, 2020 at 2:25 PM Posted in Community Conversations 0 5
We were supposed to be doing a destination wedding in Florida August 2nd. But since everyone would be traveling in from all over the country (many from covid hotspots) we decided it was best to cancel and we are eloping in Virginia where we live. All of our vendors have been great except our photographer who is refusing to refund any of our deposit of $500. I understand that the retainer is nonrefundable but obviously no one could have predicted a global pandemic. Anybody have any suggestions? Has anyone run into this issue? We may end up rescheduling the reception for Florida when the pandemic is over but the guy is being such a jerk I wouldn’t even want them to be our photographers for that.

His response was basically Florida is having wedding now so he doesn’t understand the issue.
So frustrated any advice would be great. I feel bad for all the vendors losing money.... but we are already out $3000 on the VRBO we rented that also won’t refund.

I’m unsure what you’re looking for suggestions for, but if you’re canceling instead of postponing and weddings are happening in the state you’re supposed to be getting married in, your photographer has the right to not refund your deposit. You can look over your contract with him again but I doubt you’ll find anything that insists he give your money back.

This would all come down to the contract and how it's written. Unfortunately for you, the contract probably doesn't have a clause where he refunds the deposit if you cancel, since most don't do it that way. This would probably qualify as you canceling since the state is still allowing weddings, so it doesn't fall under the "Acts of God" clause anymore. So sorry you're out so much money!!

It sucks, so many people are dealing with this!!
Unfortunately like PP said it all comes down to your contract, so unless your contract states that you should get a refund then you might be out of luck. I am so sorry you have to experience this.

I'm losing $1,100 because we downgraded from an 8 hour ceremony/reception videographer session to an elopement style. I lost half of my DJ deposit. These are all things listed in the contract. All I can say is, you unfortunately have to accept it if it's in the contract. But that doesn't mean you can't write about it in their online reviews. Obviously don't sound spiteful in your review if you do choose that route, but lay the facts out "I was getting married in FL, had to alter my plans because of a pandemic and was not given a refund." They can't really dispute anything that's true.

Unfortunately, it all comes back to your contract. If your contract says the deposit says no refunds then he isn't required to refund your money. It definitely sucks because like you said this virus couldn't be predicted, but businesses have contracts for a reason.
