Vendor contracts

Has anyone else drafted their own contract for the vendor? If so, how receptive were they to signing a contract you created versus the contract that they provided you?

    I can tell you as a vendor myself, I would not sign a contract that a client created themselves. I don’t know the situation or all the details but I have written my contract exactly they way I want it and the way I feel it will best protect me and my client. As a bride though, I’ve seen some pretty terrible written contracts. I made a few of my vendors write notes or add details on the contract that weren’t originally included. My photographer had no details, just the price and hours. I refused to sign anything until she wrote down that our package included an engagement session at a location of our choosing, two photographers, and no travel fee.

    I have not, but I’ve requested edits to every vendor contract I’ve signed so far. Basically adding terms that covered me and were more fair to me in case things go wrong. That’s generally more acceptable. A lawyer usually reviewed it for the vendor, so they wouldn’t necessarily want to sign something without that part.

    Nope. I wouldn't hire someone that didn't have their own contract. Any reputable vendor should already have a process in place.

    I don't think this is something any reputable vendor would agree to. Contracts are legal documents that not just your average person can write. I work as a paralegal and a lot of time and thought goes into properly drafting a contract since it is a legally binding document.

    A reputable vendor will have their own contracts and will not use yours.

    I agree that this is not something that reputable vendors would consider. If you're considering a vendor who is willing to use a contract that you write, then I'd take that as a red flag

    Any reputable service business will have already created a contract with their lawyers so that it's legal and protects them. Having said that, I've seen people ask for additions/edits to vendor contracts, and the vendors are free to negotiate and/or allow that. I myself have made a couple of additions to my photography contract. But it's best to start with whatever the vendor has set up. Remember they do this every day!

    Thank you - I appreciate your feedback. I have been hesitant to sign some of these contracts considering the circumstances. I will have an attorney look them over to make sure all possibilities are covered.

    But in order for a contract to be considered valid there must but understanding, acceptance, and consideration. All contracts are negotiable. Regardless as to whether or not the company is reputable - we must both be protected especially considering the uncertainties of covid.

    As a paralegal, I know what the requirements of a contract are. The reason I mentioned the company being reputable is because a reputable company will already have an existing contract which you will have the opportunity to review. If you have concerns then you would discuss those with the company and appropriate changes can be made. Unless you have years of experience writing contract, I wouldn't recommend writing your own contracts for your wedding and even if you do I highly doubt a reputable company will agree to use your contract over theirs.
