Vendor Contracts for New Postponed Date

Lee, on June 15, 2020 at 8:29 PM Posted in Community Conversations 1 6

Hi all,

We are in the process of switching over all of our vendor contracts for our new wedding date next summer and noticed one of the vendors changed their contract to include a new part that states is we cancel or postpone within 4 months we still need to pay them three-quarters of the contract price and if we postpone or cancel within 2 months we still need to pay them the full price of the contract. While I usually would not care about this, we have already gone through postponing once and know our wedding venue would not allow us to make a cancellation/postponement decision that far out. We were only able to postpone two months out recently. We hope we do not have to postpone again, but in this new world, anything is possible. Honestly, I understand that everyone is suffering during this time and need security. But I really don't think it is a fair or friendly addition to this new contract for our new date.

Would you feel comfortable signing this new contract with a vendor you originally had set for your original date? Have any of you seen something similar to this new requirement? And if so, how did you react?

Thanks!

Maybe you can speak directly to that vendor and ask if you can change that specific terms in the contract?

I have heard of this happening and in my opinion, its shady. I understand if for future clients down the road they want to include pandemic clauses or something but since they had a deal with you before all this they shouldnt have changed it. I would think that since your wedding is next summer you more than likely will not have to postpone so it probably wont even be an issue. But you should still bring it up to the vendor and say youre not comfortable signing that due to your venue’s rules about postponements

Even before covid, some of my vendor contracts included cancellation/postponing windows. The closer to the wedding you cancel, the more money is owed. It makes sense because that timeframe was booked and held with the understanding that

Ugh! I accidentally hit reply too soon

It makes sense because that timeframe was booked and held in anticipation of payment for a service. Vendors can’t allow an unlimited amount of time for a couple to change their minds. Otherwise they lose money and that date could have gone to someone who would have paid and followed through with the service.
Actually, as 90 days approached on our 10/10/20 wedding date, FH and I had a convo on whether to postpone or not because we knew that canceling 45-90 days out meant that we owed 50% of the anticipated revenue (15-44 days out owed 75%...... 14 days or less owed in full). Ultimately we decided to postpone.

I think my issue with the addition is that in this case we are cancelling or postponing because NO ONE in the area is able to get married. For example, right now, our state has expressly banned weddings until the next phase, so it’s not like the vendor would have lost out on another job because another job is not possible in this area. I understand the concept for a voluntary cancellation or postponement but not for something I have no control over. We can only make that decision once our venue allows us to pick a date and postpone.

Oh, I may have misunderstood. I thought this added section only applied to your NEW date next summer. Meaning, if you cancel 3 months before your wedding date next summer, then you owe 75% of the price. Which makes sense. So is your concern that the venue might close again next summer? Otherwise it seems that the new clause isn’t an issue if the venue is open and you can have your wedding.
