Suggestions on How to Break a Contract

Back in January, FH and I had been going full steam ahead in researching and booking our vendors. The most difficult was our photographer, after we finally decided who we wanted (and trust me, it was a difficult decision), we reached out to one that we had fallen in love with only for him to tell us he 'may' be moving. I know I'm still peeved about that, but we ended up finding the most amazing photographer within 12 hours of that awful response, so it did all work out. Our photographer has been continually amazing me every day - he's very vocal on social media (FB/Insta) and shares a lot of his work, I just keep falling more in love and getting so excited to see what he'll do with our e photos next month.

All prior to booking him, I had been looking at videographers. I am highly critical of them as I work in film myself, so I knew whichever company I went with, I had to be 100% sure. Of course, that wasn't the case,

I know this may not work out, but I figured I'd try anyway since they do have time to re-book.

It sounds like you make too many decisions in a rush and this is causing your problem. Contracts are hard to get out of unless you're ok with forfeiting your retainer unless they breached.

That is tricky. But I'd honestly just be nice and communicate due to email, (that way you have it in writing). I am cringing for you because I signed my contracts early and had some second thoughts too. I do think if you frame it to be able to rebook, they COULD be more than accommodating. I am surprised, usually it says most of the deposit is due within in 60 days of the event (because not enough time to presumably rebook)

I'd have to read the contract but that's a crazy clause if you're still responsible for $1100!

I'd let videographer know immediately that you want to cancel. I'd probably lie though and say we're eloping and see if you can void the contract. It's literally a year in advance and s/he should be able to book someone else.

Thanks for the clarification OP. That sucks. Hopefully they will work with you. They have a lot of time to rebook.

@Janel - that would be a good excuse, LoL!

@Stephanie - I'm hoping they will be accommodating, but as I mentioned before, I am willing to bite my tongue if they aren't.

@Jay - I know, I'm well aware that I made this decision too early - the other factor was that my photographers video cost is $900 more expensive then my current videographer. At the time, I hadn't saved much yet and I didn't think I'd be able to save that extra money. I was thankfully, able to do so, and because I freaked out thinking I needed to book them so early, I'm locked in. I'm going to at least see what they say, I'm not expecting miracles, but I'd rather ask then not.

    ETA: Updated some phrasing

Usually they only charge that if you're within 6 mo or so of the date. A year should be plenty of time to rebook the date

Sorry to say but you may just have to eat the money. Talk with them and see what they say but I don't see you having any legal standing in breaking contract and keeping our money. But you never know they may be willing to work with you. Still they have no obligation to do so.

Sounds like your videographer worded their contract for situations just like this. I would be surprised if they let you break contract. You shouldn't have continued looking at videographers once the 60 days were up.

This is kind of like when you buy a dress and you need to stop looking once you have it . They're will always be bigger and better , but if you were content with them when you booked they should be fine now .

I would be absolutely sure I am going to cancel no matter what if I reach out to them about it. If not, that is going to be extremely awkward if they are still doing your video.

Thanks all for the responses. I'm waiting for the video company to contact me back. I can update all if interested when I know more.
