Sales tax

Cassaundra, on January 29, 2020 at 2:03 PM Posted in Planning 0 8

Hello-

I live in Illinois and the sales tax went up...I signed my contract last year and went to make my second to last payment this year and an extra $400 was tacked onto the final costs. Has this happened to anyone? Is this allowed since we signed a contract and it does not talk about sales tax additions.

I would ask them about it. I would want to know why I am paying an extra $400 when it was said in the contract.

Ask them. I feel like this is something that was their responsibility to disclose. My venue is in a different state but they disclosed that just in case.

I would assume they have a line item for taxes. Unfortunately, those vary based on legislation and are applicable when the payment is made not when the contract is signed.

You legally should not be paying any more. Unless it states anywhere in your contract that price could change. Otherwise, once it’s signed, it’s signed.

Ugh, I live in IL as well. I don't have to make my final payment until July, so I'm not sure. But if it is different from our contract, I'll definitely say something because the contract was signed last year, not this year.

I would think unless it is stated somewhere that the price may increase, then they can’t charge you more. You have a signed contract with an amount stated.

Keep in mind sales taxes aren’t the venue’s setting. They’re taxes that are 💯 paid over to the state based on either the services or some physical good you are getting (depends on how your state determines it). I bet dollars to donuts your contract has a clause that you’ll pay applicable sales, use or gross taxes (or something like that). The vendor isn’t making money off you if it makes you feel better and failure to collect the appropriate sales taxes is probably a violation of state law on their part. If you’re still upset, write your governor or state rep 😭 the only exception would be if the vendor agreed to give you a flat rate inclusive of all taxes, fees, etc. but I’d bet that’s pretty rare.

Thanks everyone, Day 3- no response. I checked the contract and it does not say anything about taxes so fingers crossed.
