Refund

So I booked a 360 photo booth for my wedding in August. I paid my deposit in early November well after I paid my deposit I inquired about not receiving a contract. Due to holidays, I try to give him time all my vendors had been slow on contracts since we waited till November to pay all deposits, which I was not stressed about. Well come January he is the only vendor who has not reached out to me or spoken with me about my contract so I messaged him. He then informed me he wasn't sure if he could render the service due to equipment issues and in a week he would let me know something. Well, I kinda wanted to get quotes just in case he couldn't and after calling around to some of the local vendors in my area only a few had my date available but not only that most prices had doubled since last year. After discussing this with my FH we agreed it would be best to cut ties and book the only person who had our day available and the prices were reasonable. Costing us a whole 150 more than what we budgeted for but compared to double the prices it's worth it. Well, my issue is the guy has yet refunded us and he acted as if he rather us wait before he refunded us. But knowing that our dates are limited and prices have jumped up twice the amount since last year we can't stand to risk it. Am I wrong for not waiting?

    I would say it’s questionable whether you will get that deposit back. If am reading this right, you did not sign a contract with the first photo booth guy, correct? If there is no contract, this guy could definitely be shady and not return your money. But even if there was a contract, it would likely state that your deposit is nonrefundable unless the vendor is the one to cancel on you. Unfortunately, since you went ahead and booked someone else and canceled on him, that would render your deposit nonrefundable. You were put in a hard position. I think the only way you could have insured your deposit would have been refunded would have been to book someone else, but not tell the first guy. Then, if he had needed to cancel on you due to mechanical issues, you would have been owed your deposit back. But since you already canceled on him, that option is now gone. Who knows though, maybe this guy will still refund your deposit to you anyway 🤷🏼‍♀️ If not though, at least you have another vendor booked for your wedding date!

    Have you told the original photo booth vendor that you're going with a different vendor? Also, have you officially booked the new vendor? If not, can you put a soft hold on your date with the new vendor, and then wait it out a week to see if your original vendor will cancel on you? This way, you are still holding your date with the new vendor, and you also wouldn't be cancelling on the original vendor (which would give you your deposit back if/when they cancel on you).

    Cece, we didn't tell him that we booked someone we asked for him to just refund us since he can't guarantee us that he will be able to render us this service and if we wait we could be out of a photo booth completely. but I agree since we didn't sign our contract we could lose the whole deposit.

    Lisa, we didn't tell him. I spoke with the new vendor and informed her of the situation but she did inform me she cant hold my date without a deposit due to if someone is willing to pay her now she can not turn the business away because she can't risk losing money, which I totally understand. I was planning to book her tonight. she told me to ask him for a refund since he can't render me the service and let him know if he gets the equipment fixed then we can rebook even though we aren't really planning to rebook. since he is basically is refusing to give me a contract because he doesn't know if he provides me the 360 photo booth.

    That sounds like a good plan! I probably wouldn't tell your current vendor that you found a new one. Instead, I would just request that he returns your deposit, since he cannot guarantee service. Good luck, I hope he returns your deposit without issue!

    Ahhh, in that case I think you did the right thing! I definitely wouldn’t have waited any longer to find someone new, since vendors are booking up quickly. I just wouldn’t tell the original vendor that you have found a new one, and hopefully he will cancel on you and refund your deposit

    Cece, I'm glad I asked yall lol I was gonna just tell him I needed the money to secure my new vendor. I'm crossing my fingers and hoping he does just give me my money back.
