Refund Issue With Vendor

Some of you may recall last week my photographer cancelled on my 73 days out... ok. She referred me to someone and I was able to book with them, yay! They are fantastic and was our original choice, but were booked at the time. They happened to have a cancellation and now we have them!

Our original photographer told me that it was because they were moving due to military restation.. but I looked on her facebook and it looks like she and her husband aren't together anymore and she has a girlfriend, now.

All is sitting uneasy.

According to my contact if she could not fulfill her end, she had to refund any money paid. She messaged me and let me know this would not be a problem and would have me the refund by this weekend. With it now being Wednesday... I, again, messaged her and she read with no reply. I tried to call yesterday and got nothing.
My contract clearly states this policy, so that is not the issue, but at what point do I push it? & if I do, what is the next step to do this?
Luckily, I only paid the deposit, but it is still $200. Also, I made my deposit payment through PayPal, as I felt a paper trail was good on my end. I would normally just dispute this with PayPal, but this was paid LAST April Smiley ups

    I don't have any advice because I'm not sure what steps would need to be taken next, I'm just saying I'm glad you were able to get your original photographer!

    The reason she backed out is a little sketchy but oh well, now that she's not your photographer I wouldn't be too worried about that part.

    I know there's places you can reach out to for this. I can't believe people try to get away with stupid stuff like this.

    If push comes to shove, contact PayPal customer service. Since this isn't a matter of returning goods, they should be able to help you out, especially since you have a service contract that is still "in progress."

    According to PP's website... I only have 180 days, but I still plan to call them. Ridiculous!

    You should try calling and speaking to her. If still no action then you can send a certified letter (this way she has to sign for it) asking for the deposit back as per contract.
    If you still don’t get a response then you can get a lawyer/small claims court involved.

    Did the contract itself state how long she had to return the money? If I were you, I would be like you and expect it back ASAP, but I was just wondering if she put a clause about how long it too. Most of our vendors have a clause that they have a month to refund our full amount if they can fulfill.

    Like someone else said, I would send her a certified letter and then pursue it from their.

    I am sorry to hear the frustration you are going through. I do not understand why people cannot just do as they say and be honest and not sketchy. You may have to take her to small claims court. I work at a financial institution and the regulations with card companies (if it was paid with card on paypal) is that they only protect transaction for 180 days otherwise they do not get involved. In these situations Paypal would have to go through VISA, MasterCard, Discover or AMEX to get the funds directly from the merchant themselves. It is a super frustrating process which is why it is only 180 days to dispute.

    Yes, it states that she must refund money paid. It does not state time frame.

    I tried to call her again and got no where. I contacted PayPal, but since it is more than 180 days, they cannot help, but told me my bank could because the paypal transaction used my debit card. I called PNC and they were in fact able to file a dispute! I got assigned a case and just spoke to the case manage who requested the email correspondences and contract information.

    That definitely makes me feel better!!!
