Prenup

Marissa, on August 14, 2020 at 6:44 PM Posted in Planning 0 6
Does anyone know how to start the process of a prenup or who to even call? I’ve tried figuring out how to speak with a lawyer and I’m not having any luck.

Most family lawyers do prenuptial agreements. You should be able to call a family law attorney and set up an appointment to draft one. They’re going to ask for your wedding date as it has to be done prior, so if you are getting married sooner rather than later it’s best to get in contact and start the process now. In Connecticut, prenups require a detailed outline of each person’s assets, debts, and financial situation as well as negotiations with the other side (your future spouse) should there be any. I’m sure most states are similar.

Any type of family lawyer. Some dedicate themselves just to stuff like this. A simple email should be enough for them to tell you what next steps are

    A family lawyer.

Make sure if any businesses are involved (if either of you owns one), you may want to have your attorney that works on your business consult on any agreements also.

Any lawyer can write one, a family law lawyer would probably be the best option to write a prenup. In most states you will each have to have your own lawyer, or sign a waiver for a single lawyer to do it since it’s a conflict of interest for one lawyer to represent you both. Usually you also have to sign a certain amount time before the wedding. In CA it’s a minimum of 10 days before the wedding, it may be like that where you are as well.
