Pre-nup on Godzilla and Video Game collections

Charlene, on February 4, 2023 at 11:05 AM Posted in Etiquette and Advice 0 7

Okay guys, this is going to sound really, really stupid, I know that and I told my fiance that, but prepare yourselves...

As you know by now probably, we are serious collectors of Godzilla memorabilia and we also have a lot of video games worth a lot between us plus my fiance has some Magic: The Gathering cards that are also worth a lot. My fiance says he wants a prenup on his Godzilla and video game collection and he seemed dead serious about it. I was expecting it, but does this seem silly to you? I guess when something happens to our marriage he doesn't want me to fight over who gets to keep what like that couple with their beanie baby collection on the news back in the 90s. He already drafted up a list of all of his collection because he knows that things will get mixed up the longer we marry and he doesn't want it to happen. Luckily, we keep our finances pretty separate and we plan to keep doing so, but is this necessary? I did some research and it seems to cost a few thousand dollars on average to do so and we don't seem to have that kind of money to even hire a lawyer to do it.

How can I stop my fiance from worrying about his collection?

No offense but this sounds childish and while I understand this stuff is important to both of you I think in the event of divorce you will have more important things to worry a out than a Godzilla collection especially if you'd have children together.

That is what I was telling him. I also think it is stupid, I am trying to convince him not to worry about his collection and that his list he is keeping of all of his games, cards, and memorabilia is enough.

Double check your state laws, but I think most (if not all) follow the rule of anything you own prior to marriage, you keep in the case of divorce. So all property he purchased before marrying you is legally his if the marriage were to dissolve.

I second what Cece said. Also, is the cumulative total value of all his memorabilia worth the same amount or more than the cost of hiring two attorneys (you each need individual representation)?

Attorney's are expensive, like hundreds of dollars each if not more. Are his collectables worth that much? I would guess at a legal bill of around $1000 for a prenup, possibly more.

Okay, here is a quick update. I talked with my fiance and he said it was intended to be a joke and I feel dumb for taking it seriously. Stupid autism...
