Photography Contract Says I Can't Sue?

Carolyn, on October 31, 2017 at 10:03 AM Posted in Planning 0 7

We're in the process of reviewing a contract from a photographer and we're on board with everything except the clause saying we can't sue them for any reason. It says "Client Agrees to Refund - Will not sue Photographer. Client agrees not to pursue nor claim law suit against Photographer."

Is this a normal line in a photography contract?

Ask for clarification. It sounds like they are saying that you can get up to a full refund but not sue for damages beyond that.

That's the most ridiculous and unconscionable term ever. Ask her to remove it. It honestly wouldn't matter either way because that part of the contract would likely not be enforceable.

My main issue is that clauses like that don't end up in contracts for no reason. Sounds like she's had some previous legal troubles. Now that I think about it, I'd find a different photographer.

^^ What Brittney said. I'd ask about it and look online for sure.

Thank you everyone for your input! I had no idea this was so unusual and I appreciate it. We're looking into other photographers. Even though we liked him a lot, that line is definitely worrisome.

    Thanks again!

None of our contracts have anything like that in it. I would ask her to remove it or move forward with someone else
