Photographer very late returning photos

Our photographer is extremely behind on returning photos of our wedding. We were married in September in Mexico, and her contract gave her two months to present the proofs and explicitly states that the final date to send us all finished materials was December 17th, 2022. We just got the first proofs for review on January 1, 2023 after weeks of silence.

We sent our album selections within the required time frame and asked when we can expect the final delivery. She is now claiming to have an 11-month long backlog of work - just now delivering final material from weddings celebrated in February 2022 (our contract was signed in May). We’ve asked for her to reduce the delay or offer compensation for being in breach of contract, but were rejected and told that there’s nothing that can be done and that COVID acts as an extreme and total force majeure to the contract.

We don’t think this is right and she should do something - anything - aside from demand patience. Are we too sensitive or are we being taken for a total ride, told to accept performance below the agreed contract but paid at full rate?

    So if you’ve already seen the photos and chosen the ones you want, what exactly are you being forced to wait on? Editing? A photo album?

    Hi Cece! The photos we’ve seen are very small (500x333px) and low resolution, so they’re usable for preview only. At this point, we’re waiting on editing, delivery of the full-resolution digital images to share with family and friends, the wedding album, and prints for framing.

    So it sounds like editing is really all you are waiting on (because albums and prints are outsourced). There is always the option of having a professional edit the photos; which might be a good option for you if the alternative is waiting nearly a year to get your wedding pictures!! If that is a route you would like to go, I would reach out to the photographer and see if they would either: A) find a reputable editor for you, and foot the bill for that. Or B) refund you the amount it will cost for an editor of your choice to edit your photos.
    If you do reach out to them, I would be incredibly polite and word it in a way that conveys sympathy for them, as I think that would give the greatest chances of them complying. Maybe sympathize with the fact that Covid has negatively impacted their business, and that under the circumstances outsourcing the editing may be the best solution for you both, as it will alleviate some of the pressure, workload and stress from the photographer, and also get your photographs to you in an acceptable timeframe.
