Photographer problems

So long story short I’ve been married for 3 months now, our photographer contract said the latest we’d have to wait for picture is 12 weeks it is now 14 weeks. I’ve texted her multiple times and she keeps assuring me she’ll upload them and they’ll be done soon.


I only got digital proofs of my photos so I’m getting frustrated still waiting..Any suggestions what to do?

    I’d ask if she isn’t done yet that maybe she can at least send you the portion that is complete so you have something?


    I’d also be asking for some money back since she did break the contract, as she said 12 weeks and it’s been more than that. But I’d wait until she gets you the photos before you ask for money back.

    In my opinion, 12 weeks is more than enough time to get wedding photos back. Most photographers give a 8 week turn around time, so 12 should be easily obtainable!

    When she says "soon", I would take that to mean another week or so. After that, I would tell her that if she doesn't have your photos to you by XX date, you will take legal action since she has violated the signed contract. I also agree with Gen, that once you receive your photos, you should ask for a partial refund due to contract violation.

    I’d remind her of the contract and threaten to take her to court. No one is lenient with you when you sign a contract. Some of these vendors are VERY demanding to the point where some of them I feel like they think they are supposed to be guests at my wedding instead of there to do a job, but just remember that you are not allowed to break your contract or else they’d give you hell, and they should not be allowed to break it either. This is the whole point of a contract. If I were you I would definitely not be happy as you paid I’m sure thousands for these photos and that’s not something the vendor should be taking lightly.     How are you communicating? Over the phone, via text, or email? I'd try to make sure that your future communication is in writing so email may be easiest. You'll be grateful for a hard copy if you have to go to court. When she says soon, immediately ask for a date of completion. If she can give you a new reasonable date (like a few days out) then I would give her that time and hold her to it. If she gets back to you and pushes it again or the date comes and goes without her getting those photos to you then I'd politely remind her that there is a time stipulation in her contract and that she has already exceeded that time and that you expect delivery immediately. Then, seek legal counsel. As an attorney, I can tell you that their first step is often to write a demand letter before preparing a formal complaint. So your attorney will basically give her a deadline and after that deadline they'll file your lawsuit. Obviously, this needs to be handled delicately, because worst case scenario you don't ever get your photos. You would probably get your money back, but most contracts limit damages to the amount paid. I would definitely check your contract and see what it says about damages and litigation.
