Photographer Advice

Hey ladies, just needed some advice on my photographer. We have to postpone our wedding from May to August and all of my venders were available except my photographer. Our contract states cancellations can be made up to 7 days prior to my wedding without penalty. I reached out to her to see what could be done and she said she could get one of her extra photographers to go out and shoot my wedding instead of her for an additional fee of $500 but regarding cancelling she cannot afford to refund me. My family believes it’s unfair for her to charge me a fee for a photographer that is not her and I would just hate to lose the money I have already paid because she cannot afford to give it back. I also don’t want anything to get messy because I know we are all going through a tough time but I don’t know if she is taking advantage of it? My family also believes she should have to pay for the additional shooter because at this point it’s like she’s asking me to pay her $2500 just to edit and the additional shooter $500 to shoot my wedding.


I am not sure what to do at this point or just give in for the sake of being peaceful.

    Mine is being weird and won’t tell me until I have a firm date but I have no cancellation. If she can’t fulfill contract then you shouldn’t have to pay extra. It’s one or the other.

    She doesn’t owe you a refund if you’re the one canceling, but I do think that offering her second shooter for an additional fee is odd. Have you even seen photographs from this other person?

    As per your contract you can cancel without penalty so she has to refund you the money. You can easily win that in court. I wouldn’t pay extra for something you didn’t agree on contractually. You’d be paying for her not to do a service and then extra for someone you never hired or agreed to hiring. That’s unfair.

    It all depends on what the contract says. If it says you can cancel with refund. Then shes owes you a refund no matter what. Ideally, it should also outline what happens and any fees if she cant show up, but has another photographer that will replace her. All photographers I have worked with in the past/present have had something in there stating that.
    Also. It depends on what they outline their circumstances ("acts of god") section as for not getting a refund and whether or not corona counts.
    Things are hard. But contracts are contracts.

    Correct, per our contract if I cancel it states I receive my money back if the cancellation is done 7 days before the event, except the deposit of $500 of course, but I would hate for it to have to come to anything else but an agreement. I have no information or have seen any of the other photographers work. I’m also thinking it’s not completely fair and I want to try to understand her at the same time

    I agree! If the contract allows for cancellations, then it has to be honored. It is kind of you to be considerate, but it’s equally unfair that the photographer is taking advantage by charging you extra for a shooter that you did not sign a contract with. Seems a little shady to me considering you’re doing her a favor by not suing her for your money back when your contact clearly states you’re able to up to 7 days before the event.

    If this is what your contract states, then she is legally obligated to return your money, minus the deposit. We're all going through tough times financially, but it sounds like this photographer is taking advantage of the situation. A contract is a contract!
